Our Out-of-Control Court: An Explanation on what Occurred in our Beloved Nation on June 26th, 2015

Not even sure how to begin this one…Yesterday felt like a funeral – the death of our beloved nation as we once knew it. One that lived and died by the ever-reliable Constitution of the United States of America. A Constitution that was put together almost 239 years ago and abode to the “T” by 43 previous Presidents of the United States. Until a liberal, American-despising, socialist walked into our White House on January of 2009. Yes, our 44th President of the United States put an end to that…

In a short 6 plus years, Barack Hussein Obama has turned our beloved country into one that my late father (who passed away 44 days before Obama took power), would not even recognize today. My late father, Felix Guardiola, rests in peace in the loving arms of our Heavenly Father, while the rest of us have to look at photos of two men kissing on the front page of every newspaper in the country today…

How the 2% Gay population in this country – along with 5 liberal, Pro-abortion attorneys in black robes could re-define the Blessed Sacrament of Holy Matrimony, while the other 98% of the “straight” citizens of this country sit and watch it unfold – is beyond me…Why do we VOTE? Why do we go to the polls to vote if we are “for or against” Gay Marriage when these 5 Injustices are going to say: “Thank you, but your vote does NOT count”…Are these same 5 liberal judges going to throw out our vote AGAINST Marijuana next?

So, with the Presidential Elections of 2016 less than 18 months away, how do we appalled, tax-paying American citizens prepare for these elections when we just saw before our very own eyes how corrupt this American system of justice is, as even a couple of these Supreme Court Justices went at each other after this bitter and unfair decision was made? What justice are we talking about? If my vote against Sodomy was thrown out yesterday as “Null & Void” – along with the 311 million “straight”, law-abiding citizens of this country – why are we wasting our time voting? Better question:

WHEN ARE WE EVER GOING TO PUT AN END TO THIS “UNJUST” SYSTEM AND MAKE SURE THAT OUR VOTES COUNT AND THAT THE CONSTITUTION SAYS “WE THE PEOPLE” – NOT “WE THE 5 LIBERAL SUPREME COURT INJUSTICES”?

Growing up in this country, I was always taught that a democracy stands for “a fair and just ruling by the majority of the people”. How in GOD’s name did the “majority” of this country get punished in this decision while the “tiny minority” got their way, as the decision literally came down to the vote of 9 human beings – of which it only took 5 of them to re-define the Blessed Sacrament of Holy Matrimony? Two thousand years of the institution of Holy Matrimony instituted by Jesus Christ, down the drain – over-ruled by 5 liberals – 2 of whom are so-called Catholic…

You call this a democracy? You call this the Land of the Free, Home of the Brave? You call this the United States of America? Especially when 5 liberal human beings can decide the fate and future of our country – the future of our families – the future of our children…maybe even the future of Christian institutions and businesses?

Beyond surreal, as I have to re-group and continue praying fervently that the Christians and Catholics of this country use this Day of Infamy as a “wake-up call”, as so many of them are still in a deep slumber and have not even heard the news yet. Most of them still do not know what Common Core is. Well, the wholesome, devout Christians and Catholics in this country got cheated – our children and grandchildren will have to pay the dear price – but, we really have nobody to blame but ourselves. Period. This same scenario faced the Catholic Faithful back in 1973 and the Church leaders remained silent – and Roe v. Wade was passed, allowing abortion to be legal in this country. We have nobody to blame but the Catholic Church – the one that teaches us about the 5th Commandment – Thou Shall Not Kill…

Just two years ago, the Curse of Common Core presented its evil face to the same leaders of the Holy Catholic Church – and instead of saying “No, Common Core is not part of our Catholic Church teachings and it is unconstitutional and unGODly. It was not even put together for private schools, let alone Catholic schools – why would we even entertain it”? Well, when those shiny “30 pieces of silver” were presented to these same Catholic Church leaders, they decided to take the money, defy the Almighty Father & worship the Almighty Dollar. We have nobody to blame but the Catholic Church – the one that teaches us about the 8th Commandment – Thou Shall Not Steal (from our beloved children)…

And, now this…Same Sex Marriage legalized in the most prosperous, most powerful and most fundamentally-Christian country in the world. And, once again – “Where were the leaders of the Holy Catholic Church?” Hello, USCCB. Can anyone give me at least a hint? Kurtz? Dinardo? Dolan? Anybody? Weurl & Lori – too busy with the “obsolete” Fortnight for Freedom, where I think only 64 people even tuned in? Poor Cardinal Burke in Malta – my hero – whose voice could not be heard from so far away. And, our other beloved, courageous Cardinal Cordileone, in San Francisco, who the USCCB left him out to dry in the most gay state in the union…

What in GOD’s name are we doing? Are our Catholic Church leaders not supposed to follow in Jesus Christ’s footsteps in boldly proclaiming the Gospels and baptizing all nations in the name of the Father, the Son and the Holy Spirit? Were they not instructed to protect the Holy Catholic Church with all their being? What are we waiting for now – maybe a “little-too-late statement” from USCCB President, Archbishop Kurtz? Why send out a statement now, when you should have instructed your 195 Bishops to put their necks on the line for our Most Blessed Sacrament when you first fumbled the baton that my good buddy, Cardinal Dolan handed you a couple of years ago?

Is the USCCB supposed to lead by example, rather than by following? Now what? What does the Catholic Church do when 5 liberal attorneys re-defined our Most Blessed Sacrament? 70 million Catholics; over 220 cardinals, 195 bishops led by the USCCB…back to the drawing board? Back to the catechism? Back to the wall…that’s where our church leaders are at today – backs to the wall – behind the 8 ball. Always playing defense. All because we did not do what Saint John Paul II asked us to do for 27 years – “Be Not Afraid”. All because we forgot to be Pro-Active instead of Re-Active. All because we thought it was wiser to be “Politically Correct” instead of “Spiritually Correct”…Nobody to blame but the Holy Catholic Church – the one who teaches us about the Corporal Works of Mercy – where now, it is the Holy Catholic Church that is crying out for mercy…

How many more e-mails and articles like this do I have to write in order to wake up our Catholic Church leaders and all those people who claim to be Catholic? Are we finally going to hear this wake-up call – and, instead of hitting the “snooze” button – can we finally hit the “action” button? Can we finally take a bold stance for our beloved faith now that we hit rock bottom? Can we now finally honor those “first martyrs” of our Roman Church who gave up their lives for their Faith, when Tuesday, June 30th rolls around. Yes, it happens to be the “Feast Day of the First Martyrs of the Holy Roman Church”…Just wondering if the USCCB even has that marked on their calendar…

Our Out-of-Control Court

Today our nation’s Supreme Court decided that it is the Supreme Being. It spit on God’s Word and endorsed the abominable, immoral concept that the definition of marriage can be expanded to include a union between two people of the same sex.

The God of this universe is the One who created and defined marriage as a union between one man and one woman, and no one has the authority to change that definition (Matthew 19:4-5).

Further, God’s Word makes it crystal clear that homosexuality is an abomination in God’s sight and its practice is sufficient to preclude one from the kingdom of God (1 Corinthians 6:9-11).

And the first chapter of the book of Romans states that a society’s acceptance of homosexuality is a sign that it is under the judgment of God and is begging for destruction (Romans 1:18-27).

From a secular viewpoint, it must be noted that the Court’s decision, like its previous decision legalizing abortion, is unconstitutional. Such matters as abortion and marriage are entrusted to the States under our national constitution. The only proper decision by the Supreme Court from a legal viewpoint would have been for it to deny that it has any jurisdiction and that the matter of defining marriage is a power of the States.

Chief Justice John Roberts emphasized this point about State’s rights in his dissenting opinion:

“…this Court is not a legislature. Whether same-sex marriage is a good idea should be of no concern to us. Under the Constitution, judges have power to say what the law is, not what it should be… The fundamental right to marry does not include a right to make a State change its definition of marriage. And a State’s decision to maintain the meaning of marriage that has persisted in every culture throughout human history can hardly be called irrational. In short, our Constitution does not enact any one theory of marriage. The people of a State are free to expand marriage to include same-sex couples, or to retain the historic definition.”

Further, all the dissenting judges (Roberts, Alito, Scalia and Thomas) emphasized that it is completely undemocratic for the Court to impose its viewpoint concerning such an important social and moral issue on the entire nation.

Consider the words of Justice Antonin Scalia:

“Today’s decree says that my Ruler, and the Ruler of 320 million Americans coast-to-coast, is a majority of the nine lawyers on the Supreme Court. The opinion in these cases is the furthest extension in fact — and the furthest extension one can even imagine — of the Court’s claimed power to create ‘liberties’ that the Constitution and its Amendments neglect to mention. This practice of constitutional revision by an unelected committee of nine, always accompanied (as it is today) by extravagant praise of liberty, robs the People of the most important liberty they asserted in the Declaration of Independence and won in the Revolution of 1776: the freedom to govern themselves.”

Chief Justice Roberts agreed with Scalia on this important point:

“Those who founded our country would not recognize the majority’s conception of the judicial role. They after all risked their lives and fortunes for the precious right to govern themselves. They would never have imagined yielding that right on a question of social policy to unaccountable and unelected judges.”

Many years ago I remember seeing an interview of Justice Hugo Black (1886-1971) on television in which he was asked about his role as a Supreme Court Justice. He made it very clear that the role of a justice should not be to determine whether or not a law is a good or bad one, or whether it is stupid or reasonable, but only whether or not it is constitutional. The majority of justices who agreed today to Justice Anthony Kennedy’s opinion have rejected that concept. They argued that not all issues could be foreseen by our nation’s Founders, and so they argued that the Supreme Court must serve as the arbiter of those issues, not the democratic process. They ignored the fact that our Founders provided for such matters by providing for a system of constitutional amendment.

Accordingly, Justice Scalia branded the Court’s decision as a “judicial putsch.” He wrote, “The five Justices who compose today’s majority are entirely comfortable concluding that every State violated the Constitution for all of the 135 years between the Fourteenth’s ratification and Massachusetts’ permitting of same-sex marriages in 2003.” In like manner, Chief Justice Roberts called the Court’s decision an exercise in “judicial supremacy.”

Justice Scalia, known for his brilliant, scathing dissents, summed up his feelings with these words:

This is a naked judicial claim to legislative — indeed, super-legislative — power; a claim fundamentally at odds with our system of government. Except as limited by a constitutional prohibition agreed to by the People, the States are free to adopt whatever laws they like, even those that offend the esteemed Justices’ ‘reasoned judgment.’ A system of government that makes the People subordinate to a committee of nine unelected lawyers does not deserve to be called a democracy.

Justice Scalia supplied a very interesting insight into the Court itself when he pointed out that it is not representative of the nation in any way and therefore has no right to legislate. He noted that all nine justices have law degrees from either Harvard or Yale. Six are from New York or New Jersey (Scalia, Roberts, Alito, Ginsburg, Sotomayor and Kagan), two are from California (Breyer and Kennedy) and one is from Georgia (Thomas). Not a one of them is from the Southwest, nor is there a true Westerner on the Court. And most significantly, none of them are Evangelicals or even members of a Protestant denomination! Six are Catholics (Scalia, Thomas, Roberts, Kennedy, Alito and Sotomayor) and three are Jews (Breyer, Ginsburg and Kagan). Scalia’s conclusion about this make-up of the Court was as follows:

…to allow the policy question of same-sex marriage to be considered and resolved by a select, patrician, highly unrepresentative panel of nine is to violate a principle even more fundamental than no taxation without representation: no social transformation without representation.

Justice Scalia also expressed sincere concern about how the Court’s decision will impact the free exercise of religion on the part of those who differ with the decision on biblical grounds. He pointed out that the majority decision emphasized that the decision would not impact the right of believers to continue to “advocate” and “teach” their views of marriage. But the First Amendment guarantees the free “exercise” of religion, and that is a word the court “ominously” did not use.

We can be assured that there will now be an all-out assault on Christians by the Gay Mafia as they attempt to force us to violate our biblical beliefs. They will confront all Christian businesses that participate in any way in marriage ceremonies, they will insist that ministers perform their marriage rites and they will demand that churches host their weddings. And when churches and ministers refuse, there will be a demand for them to be stripped of tax exemptions and benefits (like the housing allowance for pastors). And you can also be assured that ultimately there will be attempts to make even anti-Gay speech, including sermons, illegal as “hate crimes.”

Note the date: June 26, 2015. It is the date that should be put on the headstone of our nation because it is the day that America died. We have sealed our destruction. We are now a walking-dead nation.

    Indeed, I also believe that we are a Dead Nation because when 5 judges hiding behind a long black rope Challenged the Word of God evil takes over and evil represents dead.

    The nation is not dead. Oh contraire! It has come alive with freedom to marry who you love. Cristinsanity has had a stranglehold on people for way to long. It has kept people ignorant for 2000 years. When Cristinsanity was challenged with logic, reason, and science many of those until recently were either severely harmed or killed. Priests have sex with little boys and the church is worried about grownups and their preference in sexual partners? Religion has forced its twisted message on far too many lives and religious leaders make a good living off of maintaining the irrational sky god. Why would a loving god send us to eternal damnation simply because we do not believe? Why would an almighty supreme being be so petty? Why would this same god allow priests that screwed little boys, murderers, or rapists to have eternal life by just allowing these bastards a clean slate if they simply confess?
    You believe that the entire population of this planet with the exception of those who share your beliefs — though excluding those in all rival sects – will spend eternity in an infinite hell of suffering. And yet consider your religion the most “tolerant” and “loving.”
    If there was a god why would she communicate her message through illiterate people instead of clearly making us understand her desires? Why do we need so many interpretations through mainly men who want power and wealth?
    One that believes there is a god without evidence is a fool and frankly concerns me the same as schizophrenic without medications. Pray as you wish but stay away from me and my rational world.
    Hey Dr. Rich, have you swindled enough money out of people to make in this world? It’s not god that you should fear. It is that everyone will find out you are a fraud, a liar, a con, and cannot be trusted. Sleep well knowing that the rational people that run this country are not making their decisions on what a man in the sky told them or what fallible writings of a 2000 year old book says.
