Is Gun Ownership a Right?
What does the Second Amendment say? Is gun ownership a right for all Americans? Or just for a small militia? Eugene Volokh, Professor of Law at UCLA, explains what the Founding Fathers intended.

The Declaration of Independence says, “That to secure these rights, Governments are instituted…” That is, Government’s JOB is to secure our rights, first and foremost.
With all the noise going on about guns and all of your talk about further restrictions on the rights of ALL the people, due to the actions of a VERY select few, I think it necessary to remind us all of some Constitutional things.
This video addresses many key points and, as noted in this video but not really addressed, there’s the “Justification Clause”, that is the, “A well regulated Militia, being necessary to the security of a free State” part…
The phrase, “well regulated” meant, when it was written, the same thing as in, “a well regulated clock”. That is, a clock that functions properly.
Here are some examples, from various writings from the dates listed, showing the correct usage and meaning of the phrase, “well regulated”:
1709: “If a liberal Education has formed in us well-regulated Appetites and worthy Inclinations.”
1714: “The practice of all well-regulated courts of justice in the world.”
1812: “The equation of time … is the adjustment of the difference of time as shown by a well-regulated clock and a true sun dial.”
1848: “A remissness for which I am sure every well-regulated person will blame the Mayor.”
1862: “It appeared to her well-regulated mind, like a clandestine proceeding.”
1894: “The newspaper, a never wanting adjunct to every well-regulated American embryo city.”
As you can see, “well regulated” has NOTHING to to do with government oversight of gun ownership and EVERYTHING to do with proper and normal functioning of, “A … Militia”.
As to what is a “Militia”?.. That part IS covered, quite accurately, in the video, as is what, “the people”, means and meant when it was written.
Not only is it NOT about government oversight of gun ownership, the Second Amendment was written, very specifically, to PREVENT government oversight of gun ownership.
An armed populace, is the ONLY thing that makes for that “proper function”, among the whole people, to protect and defend themselves and their: Family; Neighbors; Neighborhood; City; County; State and Country, against ANY threat, foreign or domestic.
ALL the Government institutions, laws, law enforcement agencies and social programs have DONE NOTHING to protect us. They have not stopped ONE violent criminal. They have not stopped ONE violent lunatic so STOP even talking about the further infringement on the people’s rights (and MY right) to “keep and bear arms”.
Why would ANYONE give up their ability to protect themselves? And, how could ANYONE be so blind and/or stupid to think the government will protect them?
