‘Tampon Tim’ Walz and SF63 a Minnesota bill allowing children to be castrated over the objections of a parent

There is a firestorm because J.D. Vance called a bill, SF 63 which Tim Walz allowed to pass, as state sponsored “child kidnapping.”

Oh my.

So what does SF 63 the Minnesota Legislature passed in 2023 act state?

Here is the actual language of SF 63:

A bill for an act relating to children; preventing the use of subpoenas to gather information for out-of-state laws interfering in the use of gender-affirming health care; amending child custody and child welfare provisions related to out-of-state laws interfering in the use of gender-affirming health care; amending provisions related to warrants, arrests, and extraditions related to out-of-state laws on gender-affirming healthcare; amending Minnesota Statutes 2022, sections 518D.201; 518D.204; 518D.207; 629.02; 629.05; 629.06; 629.13; 629.14; proposing coding for new law in Minnesota Statutes, chapters 260; 543.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.
[260.925] APPLICATION OF LAWS; GENDER-AFFIRMING HEALTH

A law of another state that authorizes a state agency to remove a child from the child’s parent or guardian because the parent or guardian allowed the child to receive gender-affirming health care, as defined in section 543.23, paragraph (b), is against the public policy of this state and must not be enforced or applied in a case pending in a court in this state. A court order for the removal of a child issued in another state solely because the child’s parent or guardian assisted the child in receiving gender-affirming care in this state.

EFFECTIVE DATE.

This section is effective the day following final enactment.

So, this bill protects any parent who takes, kidnaps, his or her child and takes that child to Minnesota for “gender affirming healthcare”, a.k.a. chemical or surgical castration, is immune from prosecution for kidnapping their child.

Is this kidnapping? We report you decide.

BTW, Tampon Tim Walz according to Yahoo! News factcheckers found this about tampons in boys bathrooms in Minnesota public schools,

In 2023, Walz signed a school funding bill into law containing a provision that guaranteed access to free menstrual protection to Minnesota students from the fourth through the 12th grade. This legislation required all school districts and charter schools to stock menstrual products, and the language of the law was gender neutral. It read (emphasis ours):

A school district or charter school must provide students with access to menstrual products at no charge. The products must be available to all menstruating students in restrooms regularly used by students in grades 4 to 12 according to a plan developed by the school district. For purposes of this section, “menstrual products” means pads, tampons, or other similar products used in connection with the menstrual cycle.

While the law did not specifically mention boys’ bathrooms, it also did not restrict the rule to female or girls’ bathrooms. Paired with the laws protecting children’s access to gender-affirming care, this would require schools that do not provide gender-neutral restrooms to ensure such products to are available transmasculine students — that is, students who are either trans boys or students born female whose gender expression is masculine — to access them. In theory, this could require the stocking of menstrual products in boys’ bathrooms in some cases, though the editorial board of the Minneapolis Star-Tribune argued that is not the case:

Critics contend, wrongly, that it mandates menstrual products in boys’ bathrooms. This has unfortunately been used to stoke ongoing culture wars over transgender individuals.

But the law’s actual language provides considerable flexibility for school districts to implement it, according to Deb Henton, the executive director of the Minnesota Association of School Administrators.

That might mean making these products available for free in various locations for all who need them, such as unisex bathrooms, girls’ bathrooms, the school nurse or the front office, but not necessarily in boys’ bathrooms. Henton, in an interview, lauded the “local control” the law provides for implementation, and said she’s fielded no concerns about its rollout.

At Anoka-Hennepin, the state’s largest school district, the free products are not found in traditional male-only bathrooms, a spokesman said. But they are provided for free to all in “nongendered bathrooms,” girls’ bathrooms or from health staffers.

So, the moniker of “Tampon Tim” Walz is credible as public schools can, under local control, have tampons in boys bathrooms and in nongendered bathrooms frequented by “trans boys or students born female whose gender expression is masculine.”

One cannot change their gender. If you are a boy but think you are a girl, you are still a boy, e.g. male=XY and female=XX.

Additionally a boy, XY, cannot have a menstrual cycle. However, a girl, even if she thinks she is a boy, will have a menstrual cycle. Why? Because a girl has a uterus.

Boys don’t and cannot, even if they have been castrated and surgically altered, have a menstrual cycle.

Get it? Got it? Good!

We report, you decide.
