Federal judge tosses legal challenge to new Ohio rule requiring some suspected non-citizens to show papers before voting

COLUMBUS, Ohio—

The American Civil Liberties Union of Ohio asked a federal court to block enforcement of that policy, arguing that it would result in legitimate voters being unconstitutionally blocked from casting a ballot – and not just those who hold a “noncitizen”-labeled license. The ACLU of Ohio’s emergency court filing asserted that LaRose was defying a 2006 federal court ruling that threw out a state law requiring naturalized citizens to show their certificate of naturalization in order to vote in person.

However, U.S. District Court Judge Christopher Boyko on Wednesday ruled that the ACLU’s challenge – filed in the names of several plaintiffs in the 2006 lawsuit – failed to show that the plaintiffs suffered any “undue burden on their fundamental right to vote, nor that they have suffered disparate treatment.”

Boyko noted that, unlike in 2006, Ohio now requires voters to show one of eight types of government-issued photo IDs in order to cast a ballot at the polls. Each of those forms of ID are either issued only to citizens or, in the case of Ohio driver’s licenses and ID cards, include a notation that they were issued to a non-citizen.

The judge also noted that LaRose’s office sent letters in August to newly naturalized citizens who might still have a “noncitizen”-marked license or state ID card, advising them to get a free updated license or ID for voting purposes.
