Florida Legistators Kill Bills That Support President Trump’s Immigration Agenda— Time to Fire Them?

There is a battle going on in the deep red state of Florida.

In an email titled New Developments on Florida’s Special Session on Illegal Immigration Karen Jaroch, Florida State Director for Heritage Action for America, wrote:

I want to update you on the recent developments regarding the Special Session initiated by Governor DeSantis on illegal immigration and election integrity and also express gratitude to those of you who responded to our action alert last week.

On Sunday, a group of state legislators answered the call—including Senator Blaise Ingoglia, Senator Jay Collins, Senator Jonathan Martin, Representative John Temple, and Representative Mike Caruso—and introduced bills aligned with Governor DeSantis’s comprehensive legislative proposals aimed at addressing illegal immigration and enhancing election integrity.

However, upon convening the special legislative session as required by law yesterday morning, legislative leaders quickly adjourned without advancing any of the bills, effectively killing them. Then the legislature immediately initiated their own special session and introduced alternative legislation. Representative Lawrence McClure introduced a new immigration bill, HB1B, in the House, and Senator Joe Gruters introduced an identical companion bill in the Senate, SB2B.

The legislature quickly advanced HB1B and SB2B through their respective committee stops yesterday and they will be debated and given full floor votes later today.

While the new legislation does address the issue of in-state tuition for illegal aliens, it leaves a loophole in the law that allows in-state tuition to those who have crossed our border under Biden’s watch and claimed asylum, those in our country with Temporary Protected Status, and those here under Deferred Action for Childhood Arrival (DACA).

Additionally, Heritage Action believes these bills miss significant opportunities for Florida to support President Trump and lead the nation in the effort to secure our borders. States have a crucial role to play when it comes to border security. Florida lawmakers should also pass legislation in this special session that would do the following:

  • Reduce the flow of illegal aliens into Florida by classifying the action of crossing the Florida border as a state crime and making the actions of NGOs that facilitate them criminal offenses.
  • Require local law enforcement agencies to support ICE enforcement and hold local officials accountable if they obstruct these efforts.
  • Prevent criminal “gotaways” from slipping through the legal system by creating a rebuttable presumption that no conditions of release will secure the appearance of an illegal alien at trial, and therefore, the illegal alien must be detained.
  • Deter illegal aliens from residing in Florida by reducing benefits and incentives to stay such as removing in-state tuition for [all] illegal aliens and prohibiting illegal aliens from sending wages back to their home country.
  • Suppress non-citizens from registering to vote by requiring affirmation of citizenship at registration.
  • Curb influence by foreign nationals by prohibiting their contributions to ballot measures.
