Trump’s America First bill HB1 the “TRUMP Act” passed by Florida Legislature

The HB 1 “TRUMP Act” passed out of the Legislature, is in line with President Trump’s “America First” agenda and received input from his White House.

Despite misnomers, here are some of the key policies of HB1 the “TRUMP Act”:

  • It requires an automatic death penalty for any unauthorized alien who commits murder.
  • It raises the criminal penalty classification for all crimes committed by unauthorized aliens.
  • It creates real ID requirements in Florida IDs to secure our elections, protect against fraud, and stop illegals from freely traveling throughout our country.
  • It expands ICE beds at the request of President Trump’s Administration. This will expedite deportations and prevent catch and release.
  • It strengthens penalties for unauthorized aliens who vote and disrupt election integrity.
  • It allows RICO charges to be brought against any group who helps unauthorized aliens vote illegally.
  • It changes references in Florida Statue from “noncitizen” to “unauthorized alien” to match with President Trump’s mission.
  • It creates strategies to share intelligence and support ICE in targeting transnational gangs.
  • It ends in-state tuition for unauthorized aliens.

Florida House Bill 1 (HB1) in 2025 is a package of bills that address immigration, terrorist organizations, and transnational organized crime. The bills include House Bill 1A and House Bill 1B. 

House Bill 1A 
  • Revises the definition of “criminal gang” and “transnational criminal organization”
  • Increases penalties for certain offenses if the defendant committed the crime for specific purposes
  • Allows the seizure and forfeiture of property used to facilitate criminal activity
  • Provides criminal penalties for those who organize, finance, or direct terrorist or hate group activities
House Bill 1B 
  • Revises immigration provisions, including the creation of an Office of State Immigration Enforcement
  • Creates a grant program for certain purposes
  • Addresses noncitizen voting, employment, driver’s licenses, and identification cards
  • Addresses immigration detainers, release of noncitizens from custody, and cooperation with federal authorities
  • Addresses scholarships for noncitizens

On the Chief Immigration Officer, that power will be vested in a member of the cabinet who is elected by the people and held accountable by the voters. Other proposals would make the Chief Immigration Officer someone that voters do not have any recourse on and cannot vote out of office if they do a bad job. It is critically important for the citizens of Florida to have that say. Republican majorities in both chambers supported the bill and a no vote would have meant voting in line with the Democratic minority that stood in opposition. The TRUMP Act gives our state a chance to lead on this issue and we remain hopeful the Governor decides to sign it into law.
