America’s Border Crisis Could Get A Whole Lot Worse Under Kamala Harris, Experts Say

The border crisis could reach new heights or largely remain unchanged if Vice President Kamala Harris ends up winning the presidential election in 2024, border hawks warn.

President Joe Biden withdrew from the presidential race Sunday and immediately endorsed Harris, making her the leading contender to snag the party’s delegates at the upcoming Democratic National Convention in Chicago in August. Her past voting record in the Senate, comments she’s made about federal immigration authorities and recent actions taken in the White House all signal a sharp pivot left if she were to win election.

“I would say more of the same or potentially even worse,” Eric Ruark, research director for NumbersUSA, a group that works toward limiting illegal immigration into the U.S., said in a conversation with the Daily Caller News Foundation about possible border policy changes if Harris were to replace Biden at the Oval Office. “Biden had a history of being at least rhetorically against illegal immigration.”

“Harris has yet to come out and say, ‘it’s a crime and we need to enforce the law,” Ruark continued. “Clearly she was tasked with addressing the border crisis by President Biden, and her approach was basically to say, ‘don’t come.’ That was the extent of her policy approach.”

NumbersUSA publishes “report cards” on every single lawmaker in Congress, evaluating how they performed on immigration and other border security issues. During her short time in the Senate before leaving for the White House, Harris earned an F- rating, the lowest possible score offered by the group.

The then-Senator earned failing grades for votes on a host of immigration-related issues, such as border security, interior enforcement, refugee management and amnesty, according to NumbersUSA.

NumbersUSA highlighted her 2019 co-sponsorship of the RAIDER Act, which would’ve blocked then-President Donald Trump’s construction of the U.S.-Mexico border wall, and her 2019 co-sponsorship of the FACE Act, which would’ve made it more difficult for Trump to continue border wall construction. The group also graded her vote against the Secure and Protect Act which, they argue, would’ve positively reformed the Flores Settlement.

Other border hawks expressed trepidation over Harris’ enforcement record.

“Kamala Harris wasn’t just Biden’s Border Czar, she was his Abolish ICE Director — directing the agency in charge of enforcing our immigration laws to willfully violate them,” RJ Hauman, president of the National Immigration Center for Enforcement (NICE), told the DCNF. “Now that Biden is out of the picture, she is sure to return to some of the most insane anti-enforcement positions that we’ve ever seen from an elected official.”

As illegal border crossings quickly climbed early in the administration’s tenure, Biden tapped Kamala to lead an effort to address the root causes of unlawful migration from Central America, a position many described as “border czar.” However, Border Patrol encounters at the southern border went on to reach recording-setting levels since her appointment, according to the latest Customs and Border Protection data.

Enforcement experts have noted that the root causes of illegal immigration still remain unaddressed and lawmakers in Congress have sought to hold Harris specifically responsible for the ongoing border crisis. Harris was also heavily criticized for taking so long to finally visit the southern border.

“The choice in November will now be even more clear — mass deportation or mass release of illegal aliens and violent criminals into American communities,” Hauman continued.

Harris compared Immigration and Customs Enforcement (ICE) to the Ku Klux Klan during a November 2018 Senate confirmation hearing, asking Ron Vitiello, a nominee to lead the agency at the time, if he knew there was a “perception” among Latino immigrants that ICE agents operate like Klan members. Then-Senator Harris had also suggested during a June 2018 media interview that ICE should essentially be abolished and rebuilt again “from scratch.”

Upon election to the White House, the Biden-Harris administration oversaw a monumental overhaul of the policies established by President Donald Trump that beefed up border and interior enforcement, undertaking 89 executive actions that specifically reversed or began the process of reversing Trump’s immigration policies, according to an analysis by the Migration Policy Institute.

The White House immediately halted construction of the U.S.-Mexico border wall, shuttered the Remain in Mexico program that had largely eliminated asylum fraud by keeping asylum seekers in Mexico while their cases were adjudicated in the court system, and they attempted to enforce a 100-day moratorium on all deportations.

If Trump were to be successful in his re-election bid, Ruark said the Republican would need to do more than offer criticisms of Harris, but also put forward a policy platform on how his administration would hit the ground running on day one to “undo the damage” the Biden administration has done on border security.

In his Republican National Convention speech last week, Trump promised the “largest deportation operation” in the country’s history,  finishing construction of the U.S.-Mexico border wall and other hardline approaches to border security.

One local border leader noted the incredible burden the current border crisis has placed on the district he represents.

“Under Biden with the open border, we had over 150,000 people dropped in the streets here in San Diego County from a period of about eight or nine months,” San Diego County Supervisor Jim Desmond said Monday to the DCNF.

“It put pressure on our law enforcement, put pressure on our hospitals and shelters, and we bore all the burden of these people just freely and willingly able to cross the border,” Desmond continued, noting that it was Harris who was placed into a leadership position by the Biden administration to address the crisis. “She has failed us on the border.”

Desmond noted that the border crisis isn’t a “red or blue” issue, but something that’s been affecting everyone in his district, particularly those with homes near the border who’ve had to deal with a constant flow of asylum seekers passing through their property.

Since Biden withdrew from the race and endorsed Harris, a growing number of Democratic leaders have gotten in line behind the vice president’s fledgling candidacy, establishing her as the presumptive nominee before the DNC convenes on Aug. 19 in Chicago.

“What we’ve seen from her career in the Senate and the public statements she’s made, it would only get worse,” Ruark said of the border situation. “As bad as things are, they can get worse, and that’s something we should all realize.”

The White House did not immediately respond to a request for comment from the DCNF.

A group of House Democrats facing a tough campaign cycle have called on President Biden to take executive action on the United States’ border with Mexico. The legislators from Minnesota, Arizona, Nevada, Pennsylvania and Michigan, among other states, urged Biden in a letter first obtained by CBS News to “immediately take further action to restore order at the Southern border and fix our broken immigration system.”

Mr. Biden has faced harsh criticism from Republicans and from some within his own party over his approach to immigration and the border ahead of November’s general election. That dynamic is playing out as Mr. Biden runs against former President Donald Trump, his presumptive Republican challenger, for another term.

Six suspected terrorists with ISIS ties arrested in sting operation in New York, Los Angeles and Philadelphia: sources

Six Russian nationals suspected to have terror ties to ISIS have been arrested in a coordinated sting operation spanning Los Angeles, New York and Philadelphia, The Post can exclusively reveal.

Two ICE sources confirmed to The Post they arrested the six people, who hail from Tajikistan, over the last week after the FBI contacted the agency to warn it.

Part of the investigation featured a wiretap which revealed one of the now-arrested individuals was talking about bombs, the sources said.

“Remember the Boston marathon [bombing]? I’m afraid something like that might happen again or worse,” one of the sources told The Post.

The target who was subject to the wiretap was previously released by federal authorities at the southern border with a court date next year, but it has since emerged he has potential ties to ISIS, sources said.

Neither ICE nor the FBI immediately responded to The Post’s requests for comment.

The arrests come after warnings from FBI Director Chris Wray about possible ISIS terror plots being staged on US soil and the group’s potential for exploiting the southern border.

In April, Wray warned lawmakers that a possible “coordinated attack” could take place in the US following an ISIS-K attack on a concert hall in Moscow — carried out by citizens of Tajikistan — that killed 145 people and wounded hundreds.

A Week in and ‘Biden’s Border Move Has Already Failed’: Media

So much for a Biden border crackdown. Already, people on the ground are calling the president’s “fix” a joke, pointing to the 10,000 migrants in custody from last Thursday — four times the phony limit set by the White House. “And the inflows keep coming,” The New York Post editorial board wrote in collective disgust. Barely a week in and “Biden’s BS border move has already failed,” they argue.

The supposed “crackdown” is “a total fake,” the editors insist — and the last few days seem to prove it. In the southwest, Border Patrol announced an apprehension rate of 2,600 in just three sectors (San Diego, Tucson, and Del Rio). Look, Texas Governor Greg Abbott (R) told reporters, we all know this order is a joke. “This executive order will do nothing but further an invasion into our country, inviting thousands of unvetted illegal immigrants to cross the border every single day — the exact opposite of shutting down the border.”

Worse, he points out, the policy “essentially legalizes the millions of illegal immigrants already in our country and allows thousands more to illegally cross our southern border daily.”

Even the president’s media cheerleaders are panning the administration’s insincere response. On ABC’s “This Week,” host Martha Raddatz was openly incredulous with Homeland Security Secretary Alejandro Mayorkas, insisting that it was “very hard” to call President Biden’s actions at the border a “success” when 6.5 million illegal immigrants have been caught on the southern border.

And if Democrats think this lawlessness is helping them with their base, they’re mistaken. A CBS/YouGov poll from this past week showed that 62% of voters support “a new national program to deport all undocumented immigrants currently living in the U.S. illegally” — including a majority of Hispanics (53%) and almost 40% of the president’s party. Former President Donald Trump played to that strength during a campaign stop in Phoenix on Thursday. “Biden wants an invasion,” Trump said, “I want deportation.”

As far as House Speaker Mike Johnson (R-La.) is concerned, this issue could very well be the president’s undoing. It was “interesting,” he told Family Research Council President Tony Perkins on Saturday’s edition of “This Week on the Hill,” that Biden had spent the last several months “assur[ing] the American people there was nothing he could do.” And yet, “On many occasions I met with the president,” the speaker explained. “I read him the legal authorities [he has]. I handed him a summary of all the executive action that he could take under the existing federal statutes to solve the crisis that he himself created. Remember,” he pointed out, “we documented 64 specific executive actions that Joe Biden and Secretary Mayorkas took … to open the border wide. They did it intentionally,” Johnson argued. “And for him to now feign as though he’s concerned about [it] … that he wants to fix it is just pure politics.”

How do we know that? Because, as Johnson and others point out, what Biden did won’t solve the problem. In fact, the speaker insists, “it might actually make it worse … because he’s now sent the signal that if you’re among the first 2,500 illegals every day, you get a free pass. … The whole policy is crazy.” It does not, as he highlighted, end the catch-and-release program or reinstate Trump’s hugely effective Remain in Mexico policy. “It has created a catastrophe for the country that we are going to be dealing with for decades. [And] now, just a few weeks before the first debate and on the eve of the election … he wants to be able to go out and tell people that, ‘Oh, gosh, I tried to do something.’” And yet, Johnson went on, “he won’t ever acknowledge that he is the one that created the catastrophe.”

Now his party is divided, the speaker warned, because they’ve effectively created an “open borders caucus.” Worse, his campaign is dealing with the political fallout of openly defying federal law. “He has a real problem,” Johnson said of Biden. “This past week I was in Ohio, Michigan, Illinois, Wisconsin doing events. [The crowds] are not [just] normal Republican voters. They’re new people,” the Louisiana leader explained. It’s all part of the “demographic shift going on in the country” that’s pulling Hispanics, African-American voters, and the Jewish community into the GOP camp.

“[T]they see no alternative,” Johnson pointed out. “They understand that Joe Biden has wrecked the country and turned his back on their interest and their security and their ability to put groceries on the table. All these things are going to have a huge effect in November. And I think … the Republican Party is going to have a great election year.”

ACLU Unveils Plans To Obstruct Trump’s Immigration Agenda

The American Civil Liberties Union (ACLU) on Thursday announced an outline of its plans to oppose former President Donald Trump’s immigration agenda if he’s elected in November.

The ACLU plans to use a combination of legal challenges, lobbying and coordination with liberal officials to obstruct Trump’s plans to reduce illegal immigration, which they characterize as both unethical and illegal, according to a memo released by the organization. During Trump’s first term, the ACLU helped to block several of the former president’s moves regarding immigration, such as his attempt to weaken the Deferred Action for Childhood Arrivals, or DACA, program.

“If given a second term, Donald Trump promises to decimate American communities by targeting immigrants who are already contributing members of society and blocking new immigrants from coming lawfully to the United States,” the memo states. The ACLU goes on to claim that Trump will seek mass deportations, attack birthright citizenship, try to restrict illegal immigrants from accessing public services, separate children from their families and “attack human rights at the border.”

“Litigation will be a critical component” of the ACLU’s planned response to a potential second Trump administration, according to the memo.

If Trump attempted to arrest large numbers of illegal aliens in service of mass deportations, for instance, the ACLU would take the administration to court for violating the Fourth Amendment’s prohibition on unreasonable searches and seizures due to racial profiling. Programs like those proposed by Trump “result in racial profiling, suspicionless interrogations and arrests, unjustified and pretextual traffic stops, and warrantless searches of workplaces and homes—all of which violate the Constitution,” according to the ACLU.

The ACLU plans to “work with coalition partners” in Congress to leverage the budget process to impede Trump’s deportation plans. Congress acting to limit Immigration and Customs Enforcement’s removal operations budget is one example the ACLU offers for using appropriations to make deporting illegal immigrants more difficult.

The ACLU will also deploy lobbyists to Congress to advocate for limiting where Customs and Border Protection agents can operate.

At the state levelthe ACLU will urge states to deny federal authorities access to law enforcement resources, encourage governors to pardon criminal illegal aliens to prevent them from being deported, lobby state legislatures to allow illegal aliens to obtain driver’s licenses and ask states to pay the legal fees of illegal immigrants facing deportation.

The ACLU joins a list of groups, including Protect Democracy, the Institution for Constitutional Advocacy and Protection at Georgetown University and Democracy Forward in preparing strategies to obstruct a potential second Trump administration. The Biden administration appears concerned about the possibility of a second Trump term, taking measures to protect the jobs of bureaucrats amid the former president’s plans to restructure the administrative state.

Trump’s proposed border actions are relatively popular, with 51% of Americans, including 45% of Latinos, supporting the mass deportation of illegal immigrants, according to an Axios poll released in April. A May poll from Decision Desk HQ/News Nation found that 46% of voters prefer Trump to handle the border, compared to just 26% who think Biden would do a better job.

The presidential race is close, with Trump just half a point ahead of Biden as of Thursday in RealClearPolitics’ polling average. Trump has, in recent months, been leading in polls of battleground states, though some recent polls show Biden beginning to close the gap with Trump in some key states.

The ACLU is also suing Biden over his recent executive order restricting asylum claims at the border, Axios reported.

The ACLU did not immediately respond to the Daily Caller News Foundation’s request for comment.

VIDEO: Texas Steps in, Arrests 214 Migrant Rioters Scheduled for Release by DHS

Last week, the State of Texas arrested and took custody of 214 migrants who staged a riot at the border near El Paso on March 21. They have now been charged with rioting and are in state custody, where they will be picked up by Immigration and Customs Enforcement (ICE) and put into court proceedings.

The riot, which ironically unfolded while a Congressional committee held a hearing on the Biden Administration’s abuse of our immigration laws, indeed appeared to be a literal invasion of illegal aliens. In a matter of minutes, the illegal migrants tore down fencing and stormed past Texas National Guard troops deployed to back up U.S. Border Patrol. Video of riot was captured by a crew from the New York Post, and the following day, it blanketed the airwaves. It captivated audiences, showing the reality of what law enforcement officers face on a daily basis and proving that the chaos and crisis along the nation’s border has not waded.

According to the New York Post, the migrants were initially taken into Border Patrol custody, but then were swiftly processed and scheduled for release, despite the violence, property damage, and assaults perpetrated on National Guard troops. Still, officials were able to gather information about how the riot unfolded. According to the Post:

“While in federal custody, a “cooperating migrant” identified Venezuelan national Gabriel Enrique Angarita Carrasquero, 22, to border agents as an “instigator” among the group that stormed the border…The informant said “he witnessed Angarita Carrasquero use [a] rope to pull the gate down which subsequently led to the migrant rush into the United States bypassing National Guard. The mole also pointed to Venezuelan migrant Juan Jose Colorado Gutierrez, 35, as another “one of the instigators” who used “wire cutters or bolt cutters to cut the barbed wire” on the US side of the border.”

In response, the Texas Department of Public Safety (DPS) stepped in and arrested 214 of the aliens, who were still in federal custody at the El Paso jail, and charged them with rioting. Texas Governor Greg Abbott also reinstalled razor wire and deployed 200 additional National Guard soldiers from the Texas Tactical Border Force along the U.S.-Mexico border to intercept illegal aliens attempting to enter in the El Paso area.

Because the state court set the aliens’ bond hearing for Easter Sunday (March 31), the El Paso District Attorney requested that the hearings be postponed for several days.  However, the local magistrate judge denied the request and ordered 150 of the migrants to be released.

Still, none of the aliens have actually been released from custody.  At the same time, however, not all of the aliens remain in state custody. It appears by the time the magistrate judge ordered the migrants’ release, Immigration and Customs Enforcement (ICE) had lodged detainers against all of them and assumed custody of the 150 released. In a statement issued to Houston Public Media regarding the migrant rioters, ICE said, it “will lodge an immigration detainer, and once the individual has gone through the judicial process and completed a sentence, or is otherwise released from state or local custody, that individual will be returned to the custody of [Enforcement and Removal Operations] to await a final immigration status determination. Custody status will continue to be reviewed on a case-by-case basis as the individuals go through the immigration process.”

Last Wednesday, Texas Department of Public Safety (DPS) confirmed that all the migrants involved in the March 21 riot were being held until ICE could assume custody of them. It also announced that the state had charged nine of the aliens with felony rioting charges (and of those, seven were in state custody). The migrants hailed from various countries, including Venezuela, Guatemala, Ecuador, Colombia, Cuba, Nicaragua, Honduras and El Salvador.

President Biden and the Secretary of Homeland Security did not provide comment after the rioting. However, White House press secretary Karine Jean Pierre blamed Republicans and Governor Abbott for the chaos, stating, “The razor wire, that’s [Abbott]. The National Guard, that’s him. The Border Patrol agents still did their job. They got in the way, like the governor’s plans got in the way.” She said the House of Representatives has failed to pass the Senate proposal and blamed the Governor for politicizing the issue.

El Paso has been a major crossing point for illegal migrants. In fact, the city’s mayor has issued several disaster declarations in the wake of the current border crisis. The most recent declaration from March 25 stated that “the City is faced with the imminent threat of widespread injury or loss of life resulting from a surge in transient migrants traveling to the region.” In Fiscal Year 2023, the El Paso sector had 482,095 land border encounters and over 174,000 community releases.

These disaster declarations undermine the so-called progress Homeland Security Secretary Alejandro Mayorkas claims to have made in the region. In January 2023, Secretary Mayorkas said the Department of Homeland Security (DHS) had surged resources in El Paso by deploying 100 additional Border Patrol agents and additional officers to process illegal aliens for entry. He also touted the use of taxpayer dollars to surge emergency food and shelter funding for the area. In fiscal year 2023, several organizations in El Paso received FEMA funding to support the illegal alien population in the area.

Funding provided by Department of Homeland Security to El Paso organizations via the Shelter and Services Program for Fiscal Year 2023. Congress just provided $650 million more for the program in the Fiscal Year 2024 spending bill.

It remains to be seen what will ultimately happen with the El Paso rioters.  ICE has said it will assume custody of all of the illegal aliens involved, but ICE may not deport them. Indeed, it could still release them on bond. Unfortunately, the entire incident sends the message to migrants around the world is that stepping foot on U.S. soil is almost certain to lead to freedom under the Biden Administration. Meanwhile, El Paso and other border communities will continue to bear the brunt of the crisis.
