Virginia Supreme Court Strikes Down Dem Redistricting Measure

The Virginia Supreme Court has ruled against the Democrats’ effort to redraw the state’s maps.

In April, Virginians voted to pass a new map which would have likely taken away four seats from Republicans in the U.S. House of Representatives. Now the state supreme court has ruled 4-3 that the Democrat-backed referendum is “null and void.”

“This violation irreparably undermines the integrity of the resulting referendum vote and renders it null and void. For this reason, the congressional district maps issued by this Court in 2021 pursuant to Article II, Section 6-A of the Constitution of Virginia remain the governing maps for the upcoming 2026 congressional elections,” the court’s opinion, authored by Justice D. Arthur Kelsey, stated.

The opinion called the Democrats’ effort “partisan gerrymandering of congressional districts in the Commonwealth.”

Article XII, Section 1 of the state’s Constitution requires constitutional amendments to occur before or after a general election. However, Democrats began the voting process to amend the constitution in the middle of the 2025 state elections, after 1.3 million votes had already been cast.

“While the Commonwealth is free by its lights to do the right thing for the right reason, the Rule of Law requires that it be done the right way,” the majority opinion stated.

“The purpose of Article XII, Section 1 is to give voters the opportunity to participate in the process of amending their Constitution,” the court’s opinion stated. The opinion noted that the mid-election push to amend the Constitution “ended up denying over 1.3 million Virginians their constitutional right to have a voice in the debate.”

Despite Gov. Abigail Spanberger vowing while she was campaigning that she had “no plans” to pass a redistricting measure, this was a national push by Democrats.

The state’s Attorney General Jay Jones said in a statement Friday, “This decision silences the voices of the millions of Virginians who cast their ballots in every corner of the Commonwealth, and it fuels the growing fears across our nation about the state of our democracy.”

Jones believes the Virginia Supreme Court “contorted the plain language of the Constitution” and called the ruling a “wrong legal conclusion that fit their political agenda.”

“My team is carefully reviewing this unprecedented order and we are evaluating every legal pathway forward to defend the will of the people and protect the integrity of Virginia’s elections,” Jones stated.

Former Virginia Governor Glenn Youngkin stated on X, “Justice has been served.”

“Abigail Spanberger and Democrats in Richmond knowingly violated our constitution to disenfranchise millions of Virginians,” Youngkin stated.

Sitting members of Congress from Virginia have been holding out on announcing their re-election campaigns until the courts ruled. On Friday, Rep. Ben Cline, R-Va., said in a statement, “Democrats broke laws that they helped write in the first place, blew through deadlines, wrote a biased and misleading ballot question, and lied to the voters in all of their advertising to support the referendum,”

“The voters of Virginia banned gerrymandering six years ago, and that ban remains in effect today,” Cline continued. “This is a great day for fair elections and the rule of law, and it’s a great day for the Commonwealth of Virginia.”

Rep. Jen Kiggans, R-Va., called the ruling a “victory for Virginians’ right to fair and adequate representation against the democrats’ attempt to unfairly grab power through an unconstitutional gerrymander of Virginia.”

“I believe they decided correctly and set aside the redistricting efforts by the state legislature,” Rep. Morgan Griffith, R-Va., said in a statement. “I commend the [Virginia] Supreme Court for its diligence and fortitude. I look forward to continuing to serve the 9th Congressional District of VA.”

National Republicans celebrated the ruling as a win for free and fair elections.

“The National Republican Congressional Committee was proud to lead and fund this fight to uphold the Virginia Constitution and protect fair representation, and this win is yet another sign Republicans have the momentum heading into November. We’re on offense, and we’re going to win,” committee Chairman Rep. Richard Hudson, R-N.C., said in a statement.

The ruling comes amid a major redistricting effort by both parties. Earlier this week, conservative coalitions succeeded in ousting anti-redistricting Republicans in the Indiana state Senate primaries.

Last week’s Supreme Court ruling in Louisiana v. Callais allowed Southern states to more aggressively pursue the possibility of new maps. Louisiana has since called off its House primary to allow for a redrawing of the congressional map. Tennessee Republicans have also approved a new map.

South Carolina is still considering whether to redraw its map, although Gov. Henry McMaster has proposed the session. Alabama may face legal trouble in its redistricting efforts, but Republicans are challenging a court’s injunction.

Republicans may soon pursue a redistricting effort in Mississippi. Georgia has passed on changing its map ahead of the midterms, but a new map for 2028 remains an option.

This story is developing and will be updated.

Florida Rolls Out Congressional Map That Could Erase Virginia Dems’ Gerrymander Advantage

Republican Florida Gov. Ron DeSantis unveiled a newly drawn congressional map that could hand Republicans a major advantage.

Republicans would gain four seats if the new congressional map were to pass, which would cause Florida’s delegation in the House to be represented by 24 Republicans and three Democrats, Fox News first reported. The new map was released after voters in Virginia approved a referendum that would give Democrats an advantage in ten out of 11 of the state’s congressional districts.

DeSantis said Republicans have been fighting for fair representation since the 2020 census, stating that the population in Florida has shifted from a Democratic majority to a 1.5 million Republican advantage.

“Florida got shortchanged in the 2020 Census, and we’ve been fighting for fair representation ever since,” DeSantis told Fox News. “Our population has since grown dramatically, and we have moved from a Democrat majority to a 1.5 million Republican advantage. Drawing maps based on race, which is reflected in our current congressional districts, is unconstitutional and should be prohibited. Our new map for 2026 makes good on my promise to conduct mid-decade redistricting, and it more fairly represents the makeup of Florida today.”

Fifty-one percent of Virginians approved the proposed congressional map Tuesday, though a circuit court in Tazewell County declared it unconstitutional. The Virginia Supreme Court heard oral arguments on the matter during a Monday hearing.

Democrats currently hold six seats in Virginia, while Republicans hold five.

The U.S. Supreme Court upheld Texas’ redistricting map Monday, which gives Republicans five additional seats in the House of Representatives. California also implemented Prop 50, which temporarily allows Democrats to redraw its congressional maps to help Democrats.

Judge Deals Huge Blow To Democrat Attempt To Gerrymander Virginia

A state court rejected a Democratic mid-decade redistricting effort in Virginia on Tuesday, dealing a major blow to the party’s chances of gerrymandering House seats there ahead of the midterms.

Circuit Court Judge Jack Hurley Jr. cited four procedural errors in the proposed constitutional amendment to allow the redistricting. Some of the states’ Democratic lawmakers pushed for a lopsided gerrymander with as many as 10 seats favoring the party and only one seat favoring Republicans — a stark contrast to Virginia’s current House delegation of six Democrats and five Republicans.

An Oct. 31, 2025 vote on a procedural resolution to allow the redistricting measure to come before the state legislature passed “strictly along party lines,” the court noted. Four procedural moves were found to be in error according to the order, including the proposed Constitutional Amendment being “neither published by the Clerk of the House of Delegates, nor was it posted at the front door of every Courthouse.”

The court also cited an error in the timing of the vote, “some forty-three days after voting began in the 2025 General Election for the House of Delegates, wherein more than one million votes (approximately 40% of the 2025 Vote Totals) had already been cast.”

Recently-inaugurated Gov. Abigail Spanberger did not endorse nor condemn the redistricting effort during her campaign. Multiple outlets, including Politico and The Washington Post, have reported that Democrats are expected to appeal the decision.

FBI Agrees To Hunt Fugitive Dems Fleeing Texas Redistricting Vote

The Federal Bureau of Investigation (FBI) agreed to help locate Texas Democratic lawmakers who left the state to block a vote on a redistricting plan, Republican Texas Sen. John Cornyn announced Thursday.

Cornyn said the FBI agreed to his request to help track down dozens of lawmakers who fled Texas in an attempt to block the vote, according to a New York Times (NYT) report.

Cornyn requested the FBI’s assistance in a letter Tuesday, claiming the Democratic lawmakers may have broken state bribery laws in backing efforts to block a vote on Texas’ redistricting plan by allegedly accepting funds from outside groups.

Groups connected to billionaire donor George Soros and failed Texas candidate Beto O’Rourke are allegedly covering expenses for Democrats who fled the state to oppose the Republican redistricting effort, The Texas Tribune reported.

“I am proud to announce that Director Kash Patel has approved my request for the FBI to assist state and local law enforcement in locating runaway Texas House Democrats,” Cornyn said in a statement.

“I thank President Trump and Director Patel for supporting and swiftly acting on my call for the federal government to hold these supposed lawmakers accountable for fleeing Texas.”

The deployment of federal agents could spark a conflict between the Trump administration and Illinois officials, where many of the missing Democrats are staying.

The Texas lawmakers have been staying at a hotel in St. Charles, Illinois, outside Chicago, the NYT reported.

While their location is no secret, the Democrats apparently believed they were safe from arrest since they were outside the reach of Texas law enforcement.

As of publication, it is uncertain whether federal agents will take any action, or what role they might ultimately play in locating the lawmakers, the NYT noted.

Democrat Illinois Gov. JB Pritzker responded to the idea that federal agents could be deployed against the Texas lawmakers present in his state.

“There literally is no federal law applicable to this situation, none they can say that they’re sending FBI,” Pritzker said Wednesday, according to the NYT.

He implied that federal law enforcement might be deployed to pressure or intimidate the lawmakers, even without grounds for arrest, the outlet reported.

“The FBI agents might show up just to, I don’t know, again, to put a show on,” he said.

Cornyn stated Thursday the FBI will help state law enforcement find the individuals who defied the law by crossing state lines.

“The FBI has tools to aid state law enforcement when parties cross state lines, including to avoid testifying or fleeing a scene of a crime,” he wrote in his letter to Patel. “Specifically, I am concerned that legislators who solicited or accepted funds to aid in their efforts to avoid their legislative duties may be guilty of bribery or other public corruption offenses.”

A total of 51 Texas lawmakers traveled to Illinois to prevent the state House from reaching a quorum, aiming to block a vote on the proposed redistricting map.

Since Sunday, many Democrats have remained in Illinois to keep Republicans from securing the necessary votes for the congressional map.

The new Texas redistricting map would reshape five Democratic-held districts to favor Republicans in the 2026 midterm elections.

The FBI declined to comment to the Daily Caller.
