Supreme Court Rules In Favor Of Trump Admin On Government’s Ability To Deny Admission To Green Card Holders

The Supreme Court ruled in favor of the Trump administration Tuesday, allowing immigration officials to deny green card holders admission to the country.

The court’s 6-3 ruling in Blanche, Acting Attorney General v. Lau allows border officials to deny admission — permission to remain in the U.S. indefinitely — to a legal permanent resident (LPR) suspected of crime under certain circumstances, authorizing officials to parole such LPRs instead.

Authorities typically view LPRs as already admitted to the U.S. when they return from temporary travel, under the Immigration and Nationality Act (INA). This allows traveling green card holders to avoid the rigorous processing new immigrants must undergo.

However, the INA provides an exception when an official believes the LPR has committed a “crime involving moral turpitude,” according to court documents. The court ruled border officials do not need to have “clear and convincing evidence that a lawful permanent resident has committed” such a crime before they consider denying that resident admission, according to Justice Clarence Thomas‘ majority opinion.

The case came to the court after Muk Choi Lau, a Chinese citizen and green card holder, appealed an immigration officer’s 2012 decision to place him on parole after he returned from a short trip. New Jersey had accused Lau of trademark counterfeit in May 2012, but Lau decided to travel to China prior to the trial and was paroled upon his return. Lau appealed the parole, arguing the government should have designated him as an “already admitted” LPR instead of labeling him as an applicant “seeking admission,” according to court documents. This distinction allowed the Department of Homeland Security to take swifter action in deporting him.

Trump administration officials argued that suspicion of a crime is a sufficient reason for placing an LPR on immigrant parole.

Blanche v. Lau overturned a Second Circuit Court’s ruling that border officials need “clear and convincing evidence” of crime prior to denying admission, instead concluding that Lau had been “correctly charged with inadmissibility.”

“At step one, the Government regarded him as an alien seeking admission because he had committed a crime involving moral turpitude before attempting to reenter the country. At step two, he was inadmissible and therefore removable because he had been convicted of a crime involving moral turpitude,” the majority opinion reads.

Justice Ketanji Brown wrote the dissenting opinion, with Associate Justices Sonia Sotomayor and Elena Kagan concurring. Brown argued that the court’s decision “allows the Government to deem an LPR to be ‘seeking an admission’ first and justify the applicability of an exception later — undermining the statutory scheme as well as the benefits and security that come with having a green card,” according to court documents.

Biden Repeatedly Ignored Warnings About Border Crisis, Feared Backlash From Left, Insiders Say

President Joe Biden reportedly ignored early warnings from advisors that his immigration platform could create a border crisis and dragged his feet on solutions as crossings reached historical levels.

Before Biden was sworn in as the 46th president of the United States, experts were already cautioning his transition team that his immigration positions would likely stir chaos at the Mexico border, according to administration insiders who spoke to the New York Times. Biden and his team rebuffed these warnings, concerned they would lose Latino support and underestimating how much Americans would care about the issue.

“A potential surge could create chaos and a humanitarian crisis, overwhelm processing capacities, and imperil the agenda of the new administration,” read a memo created by several aides before the 2020 presidential election, which was obtained by the NYT.

That memo proved prophetic after Biden immediately got to work on dismantling the border enforcement apparatus established by the first Trump administration and overseeing the largest spike in illegal immigration.

Biden undertook a total of 296 executive actions on immigration in the first year of his presidency, according to an analysis by the Migration Policy Institute. Of these executive actions, 89 reversed or began the process of reversing President Donald Trump’s immigration policies.

The Democrat scrubbed major initiatives undertaken by the first Trump administration, such as ending border wall construction, the shutdown of the Remain in Mexico program and ending the COVID-era Title 42 health order that quickly expelled migrants.

Those actions quickly paved the way for a flood of illegal migrants descending into the country.

There were roughly 8.5 million southern border encounters during Biden’s time in the White House, with fiscal year 2023 and fiscal year 2024 being the worst years for migrant crossings in history. These numbers not only overwhelmed federal immigration officials and border states, but also became a problem for local officials in the interior of the country, forcing leaders in New York City, Denver and elsewhere to get tougher on illegal migrants.

As the situation at the border continued to escalate, the Biden administration reportedly kept rebuffing proposals to stem the situation out of political fears.

“They were a little too sensitive to criticisms from the left,” Cecilia Muñoz, who oversaw domestic and economic policy for the Biden transition team, said to the NYT.

The crisis dramatically changed Americans’ outlook on immigration enforcement, with polls at the time showing illegal immigration to be a top concern for Americans and more voters believing Trump would better handle the issue than Biden. A February 2024 YouGov survey found a mere 31% of Americans believing Biden to be the better candidate to fix the border, compared to 45% for Trump.

By the summer of 2024, a majority of Latino voters supported mass deportation of illegal migrants, smashing the Biden administration’s assumption that hawkish border policies would alienate the constituency.

In the waning days of their administration, both Biden and Vice President Kamala Harris — who eventually became the Democratic presidential nominee — campaigned heavily in favor of a Senate border bill that, they argued, would’ve solved the border crisis. While Biden blamed Trump for not supporting the bill, insiders say the Biden White House initially wanted nothing to do with the legislation.

Democrat Connecticut Sen. Chris Murphy and GOP Oklahoma Sen. James Lankford, the bipartisan pair of lawmakers behind the Senate border bill, said the Biden White House refused to get involved when negotiations first began to gain momentum, according to the NYT.

“We don’t want our fingerprints on these negotiations,” Lankford recalled the White House saying to him, according to the NYT. It was reportedly only after border crossings continued to surge did Biden’s team finally get on board. However, by that time Trump had firmly established himself as the Republican presidential nominee and made clear he did not support the bill, tanking any chance of GOP support.

By the summer of 2024, Biden finally issued an executive order that restricted the number of border crossings, a move that ultimately helped drive down the border crisis, but came too late for an electorate that had already decided Trump was the better candidate on immigration enforcement.

The Biden administration “had no strategy, because they had no goal,” Scott Shuchart, who joined the Biden White House in 2022 as a senior adviser at Immigration and Customs Enforcement, told the NYT.

“All they had was wishing the problem would go away so that they could focus on the things they cared about,” Shuchart continued.

California Will Spend 28x More On Healthcare For Illegals Than State Law Enforcement

California expects to spend 28 times more on health benefits for illegal aliens than on state police in the 2025-2026 budget period.

Democratic California Gov. Gavin Newsom’s final budget allocates $348 million to law enforcement while the state’s own budget experts in an October report estimate the tab for giving full health benefits for illegal aliens amounts to $10 billion. The new report by the state’s Legislative Analyst’s Office (LAO) reveals a 35% higher figure than the $7.4 billion cost Newsom estimated in his January 2025 budget proposal.

California’s joint state-federal Medicaid program, Medi-Cal, provides comprehensive coverage for doctor’s visits, medications, and dental and vision care for 1.7 million illegal aliens, who represent 11% of the program’s enrollees, according to the LAO report. Illegal immigrants’ health benefits will consume a fourth of the Medi-Cal money flowing from state coffers.

“The Governor is committed to effective crime reduction, which is why California’s crime rate has been rapidly declining in recent years,” said Diana Crofts-Pelayo, a spokesperson for Newsom, said in a statement to the Daily Caller News Foundation.

“Like other states, law enforcement budgets in California are funded primarily through local funding,” Crofts-Pelayo added, pointing to a February 2025 report on city and county spending on police.

But amid a battle in Congress over health spending for illegal immigrants and in the courts over President Donald Trump’s National Guard deployments to Los Angeles and other cities to protect Immigration and Custom Enforcement (ICE) facilities amid a surge in threats, the statistic provides another illustration of the blue state’s priorities.

Newsom, a frequent Trump critic who has hinted at 2028 presidential aspirations, has championed the policy, making California the first state to provide all immigrants meeting income requirements access to Medicaid in 2022. Newsom touted the move as achieving “universal access to health coverage” — even as he backed off promises of a completely state-subsidized single-payer model.

He recently touted “universal health care” as among his accomplishments in an October CNN interview.

Newsom also criticized Trump’s National Guard deployments to protect Immigration and Customs Enforcement (ICE) facilities in an Oct. 20 amicus brief dated as an affront to “states’ sovereign rights to handle any public safety matters,” even as public safety received a short shrift under Newsom compared to health benefits for illegal aliens.

Expansions of the policy to include illegal aliens of any age on Medi-Cal drove spending on the program skyward to more than double the initial estimates, LAO’s report says.

While on paper the state must only use its own funds for illegal immigrants, in practice, California obtains federal Medicaid dollars for its pet priorities through complex accounting.

California exploited a loophole in Centers for Medicare and Medicaid Services (CMS) rules to obtain extra Medicaid matching dollars, Niklas Kleinworth, a policy analyst at Paragon Health Institute, told the DCNF. Even former President Joe Biden’s CMS said California’s policy was not in keeping with “the intended design” of their rules, per Paragon, a non-partisan policy research institute founded by Brian Blase, former economic policy advisor to Trump.

“What they did was technically legal, so you can’t call it defrauding the government, but it really was an abuse of the intent of the policy,” Kleinworth told the DCNF. “They got very crafty.”

Trump’s signature One Big Beautiful Bill signed into law in July scaled back states’ ability to obtain Medicaid dollars this way, leaving California scrambling for new revenue streams, the LAO report shows. Newsom also negotiated with legislative Democrats throughout the final two quarters of the 2024-2025 budget period on changes to stop the bleeding.

California Democrats finalized their plans in June: In January 2026 the state will implement a freeze on all illegal adult enrollment, with the revocation of dental coverage and a reduction in certain clinic payments to follow.

In July 2027, the state will introduce a $30 monthly premium — a cost 96% lower than the average $650 that Californians with employer-sponsored plans pay.

The LAO report proposes a tax on the uninsured of $900 or more to make up the shortfall while maintaining programs like the Medicaid expansion for illegal immigrants.

Plans with premiums that cheap are “unicorn policies” for most Americans, Kleinworth told the DCNF.

“The only way a $30 premium exists is through the heavily subsidized Obamacare plans,” said Kleinworth.

In order to qualify for such a plan, an American household could earn no more than 150% of the poverty level, or $23,475 per year for a single adult, far less than the state’s $76,190 median income.

Newsom dismissed criticism of California policy priorities as the product of “California derangement syndrome” in an October Bloomberg interview.

Illegal Immigrant Superintendent Nabbed By ICE Helped Pass Policy Allowing Criminals To Be Hired In District

The illegal immigrant with a criminal record caught running Iowa’s largest school district championed and helped pass a policy that makes it easier for criminals to be hired in the district.

Immigration and Customs Enforcement (ICE) agents on Friday arrested Ian Roberts, a Guyanese national who is in the country illegally but was nevertheless serving as the Superintendent of Des Moines Public Schools (DMPS). When he was hired, Roberts already had a criminal history relating to the illegal possession of a firearm and which the district knew about at the time, according to the Des Moines Register.

The district changed its hiring practices to make it even easier for this to happen again with a new policy Roberts personally recommended and helped to get enacted.

Individuals with criminal records were previously automatically disqualified from working within the schools, but Roberts said at the time the policy change was necessary to diversify DMPS’ staff, according to the Des Moines Register.

“I believe that people are so much better than the worst thing they’ve ever done,” Roberts said at a public forum at the time. “I have overturned at least … five or six decisions around not hiring individuals based on something in their background because they have an opportunity not only for them to be redeemed, but for them to add value to the students that we are serving.”

The school board at the time also supported the decision, according to the Register.

DMPS did not respond to the Daily Caller News Foundation’s request for comment.

Roberts was found in possession of a loaded handgun, a fixed blade hunting knife and $3,000 in cash at the time of his arrest.

DMPS claims it went through a third-party to run a background check on Roberts and insists he supplied the necessary documentation to be declared eligible for U.S. employment. Roberts was also selected for the position through a consulting agency in 2023, and the board opted to vet him behind closed doors. The district said it was told Roberts’ “background check did not raise issues and Dr. Roberts said he was a U.S. citizen on the application.

ICE issued a final removal order for Roberts in 2024, which the school claims it was not aware of. The district said the news “came as a shock” but said that despite the “very serious” allegations made by ICE, the district would wait for “all of the facts.”

“[W]e all need to cool down the rhetoric,” DMPS said in an announcement. “We should promote true discourse and facts, not spread misinformation meant to divide us.”

Roberts was placed on administrative leave on Saturday evening.

Iowa state law requires school staff undergo criminal background checks prior to hiring and every five years after that.

Here’s How Schools Are Catering To Illegal Immigrants While Avoiding Federal Scrutiny

Several schools are trying to fly under the radar with programs providing education to illegal immigrants despite the Trump administration cutting funding for such initiatives.

The Trump administration on June 30 announced it was revoking nearly $7 billion in federal grants that went towards teaching English as a second language — used in part for illegal immigrants — saying the funds are being used to push “a radical leftwing agenda.” Now, some schools are advising staff to use private messaging tactics and are wiping details from their websites to cover their tracks, The 74 reported.

“Because of the threats from the federal administration about revoking the 501(c)(3) status of nonprofits, we want to keep ourselves from being targeted,” an employee of an organization that works with undocumented youth, who chose to remain anonymous, told The 74. “Anything that could be perceived as obstructing or challenging federal immigration policies, we don’t put in writing. Anything that could be seen as a criticism of the administration — or anything that could be seen as partisan — we’re going to completely avoid.”

Some schools and leftwing activist organizations are advising members to use secure messaging apps like Signal rather than text or email, or conduct conversations over the phone, The 74 said. Staff are also directed not to participate in any protests or rallies in support of illegals to avoid the federal government’s radar.

“We’re not trying to draw attention,” an administrator for an Illinois school district told The 74 on condition of anonymity. “I don’t want any light shining on our district.”

The funding being withheld from schools went towards after-school and summer school programs mainly focused on adult education and English learning for non-speakers. The Office of Management and Budget is currently reviewing whether to release some or all of the funding after it discovered some schools used it for illegal immigrants, according to The Detroit News.

School administrators and consultants are even being advised to avoid certain words in emails, such as terms related to diversity, equity and inclusion (DEI), to prevent communications from being discovered through Freedom of Information Act (FOIA) requests, The 74 reported.

The Trump administration has also taken aim at states that provide special benefits to illegal immigrants, including several that offer in-state tuition prices for illegals. Texas even joined on to the Department of Justice’s (DOJ) lawsuit against the state to overturn the law allowing the policy, with the state now asking colleges and universities within the state to identify the illegal students.

Reining in illegal immigration has been a main priority of the administration, especially after the Biden administration allowed hundreds of criminal illegal migrants to flood into the U.S. Roughly 11 million total border encounters occurred at the southern border throughout the Biden administration.

So far, the Trump administration has facilitated the arrests of over 30,000 illegal immigrants in the U.S., about half of whom it claims are convicted criminals. Border crossings have plummeted since President Donald Trump took office, with no illegal migrants released into the U.S. in May.

Kamala-Backed Border Bill Would Allow Illegals Deported By Trump Back Into Country

Kamala Harris touted the U.S. Citizenship Act, a House bill which would open a pathway for illegal immigrants deported by former President Trump to apply for legal status.

The U.S. Citizenship Act of 2021 would establish “an earned roadmap to citizenship for undocumented individuals,” according to a White House press release.

Illegal immigrants applying for temporary legal status would have to be physically present in the United States on or before January 1, 2021. However, there is one exception to the rule.

Illegal immigrants the Trump administration deported would be eligible for temporary status even if they were not physically present in the United States, according to the bill.

“With respect to a noncitizen who was removed from or who departed the United States on or after January 20, 2017, and who was continuously physically present in the United States for not fewer than 3 years immediately preceding the date on which the noncitizen was removed or departed, the Secretary may waive, for humanitarian purposes, to ensure family unity, or if such a waiver is otherwise in the public interest,” the bill reads.

Kamala Harris touted the bill during her tenure as Vice President. It’s even mentioned in the Democratic Party’s 2024 platform.

In June 2021 Harris thanked Democratic New Jersey Sen. Robert Menendez for “leading the way on the U.S. Citizenship Act.”

She also stated during her Democratic National Convention acceptance speech that she would create a pathway for citizenship for immigrants.

“The U.S. Citizenship Act would permanently increase family-sponsored and employment-based immigration,” the party platform reads.

Besides allowing any of the approximately 1.5 million illegal immigrants the Trump administration deported back into the country, the bill would also provide a pathway to permanent legal status and citizenship to illegal immigrants living in the United States.

It would change the word “aliens” to “noncitizens” in U.S. immigration law.
