House Lawmakers Overwhelmingly Pass Legislation To Crack Down On Illegal Migrant Criminals

The House of Representatives overwhelmingly passed legislation Tuesday to require federal immigration authorities to detain illegal migrants who commit theft-related crimes in the United States.

The legislation passed decisively 264-159 with every Republican lawmaker that voted supporting the bill, which would give Immigration and Customs Enforcement (ICE) and state governments more authority to curtail illegal immigration. Nearly 160 Democratic lawmakers opposed the bill’s passage.

The bill, known as the Laken Riley Act, is sponsored by Georgia Republican Rep. Mike Collins and seeks to honor the memory of Laken Riley, a University of Georgia nursing student who was murdered by an illegal immigrant while out on a run near her college campus in February 2024.

“An illegal criminal came into my district and killed Laken Riley because our law enforcement did not have the tools to stop him,” Collins told the Daily Caller News Foundation Monday. “Laken fought until her last breath, and so will I until this bill crosses the finish line and lands on the President’s desk.”

Speaker Mike Johnson’s decision to make the Laken Riley Act the first bill the House voted on during the 119th Congress signals addressing border security and cracking down on illegal immigration will be a top priority for House Republicans this year.

The Laken Riley Act seeks to address a policy failure regarding ICE and local law enforcement’s failure to detain illegal migrant criminals that commit low-level crimes that became glaringly obvious to lawmakers in the wake of Riley’s murder, Speaker Mike Johnson told reporters during a House GOP press conference Tuesday.

“There are real consequences to policy decisions, and this one was deadly,” Johnson told reporters.”

Riley’s killer, Venezuelan national Jose Antonio Ibarra, had a criminal record in the United States prior to murdering Riley. Ibarra was arrested in October 2022 for allegedly shoplifting at a Walmart in Athens, Georgia, but was ultimately released because the shoplifting charge was a misdemeanor.

If the Laken Riley Act passes the Senate and is signed into law by President-elect Donald Trump, ICE would be required to detain illegal migrants like Ibarra who commit theft-related crimes in the United States, according to the bill text.

“Right now, ICE is unable to detain and deport these illegal criminals who commit these minor level crimes, but the Laken Riley Act will fix this and give ICE and our local law enforcement the tools to get these criminals out of our country and make our communities safer,” Collins said during floor debate on the bill.

“With Joe Biden, Chuck Schumer and the party of lawlessness out of the way, the radical left’s mission to enable criminal illegal aliens…at the expense of law-abiding Americans is no longer going to be tolerated,” Republican Minnesota Rep. Tom Emmer, House Majority whip, said during a House GOP leadership press conference on the Laken Riley Act Tuesday. “The tragic and preventable murder of Laken Riley serves as a stark reminder of the consequences of failed leadership.”

Many House Democratic lawmakers, led by Maryland Democratic Rep. Jamie Raskin, ranking member of the House Judiciary Committee, slammed the bill for expanding the number of illegal migrants in the United States that could be required to be detained by ICE, and voiced concern that the bill’s passage would lead to illegal migrants who are wrongly accused of theft-related crimes being detained by federal immigration authorities.

“Their bill [Laken Riley Act] today is an empty and opportunistic measure,”  said during floor debate on the bill. “This is a radical departure from current law, which since 1996 has generally required mandatory detention only for persons who are criminally convicted or who admit to having committed certain serious crimes.”

The Laken Riley Act was notably backed by Riley’s family who believe the bill’s passage will prevent the deaths of additional Americans at the hands of illegal migrants.

“The Laken Riley Act has our full support because it would help save innocent lives and prevent more families from going through the kind of heartbreak we’ve experienced,” Allyson and John Phillips, Laken Riley’s mother and stepfather, told the DCNF. “Laken would have been 23 on January 10th.  There is no greater gift that could be given to her and our country than to continue her legacy by saving lives through this bill.”

“Every single member of Congress should be able to get behind this purely commonsense bill that will make our country and communities safer,” Riley’s mother and stepfather added. “We thank Congressman Mike Collins, Senator Katie Britt, and Senator Ted Budd for continuing to work to honor Laken’s legacy and get this legislation enacted into law.”

Republican Alabama Sen. Katie Britt introduced companion legislation in the Senate Tuesday with every Senate Republican supporting the bill’s passage and Democratic Pennsylvania Sen. John Fetterman signing on as a cosponsor. The Senate is slated to vote on the legislation as early as Friday, a senior GOP aide told the DCNF.

“Congress has an obligation to Laken, her family, and to families in every corner of our country to do everything in our power to help prevent this type of tragedy from occurring again,” Britt told the DCNF. “That’s why it’s imperative we pass the commonsense Laken Riley Act with all due haste.”

Collins originally introduced the Laken Riley Act in the House last Congress following Riley’s murder. The House passed Collins’ legislation in March 2024 with most House Democrats — 170 Democratic lawmakers in total — opposing the legislation.

Former Senate Majority Leader Chuck Schumer did not formally move to take up the legislation, forcing Collins to reintroduce his bill in the 119th Congress, which began Friday.

John Thune Reveals Why He’s Having Senate Take Up One Bill In Particular As Its First Order Of Business

Senate Majority Leader John Thune revealed to the Daily Caller News Foundation Monday that the Senate has chosen to crack down on illegal migrant criminals as its first order of business due to an “urgent need” for action amid the Biden-Harris border crisis.

“Laken Riley’s horrific murder at the hands of an illegal alien should have never happened,” Thune told the DCNF. “There is an urgent need to take action regarding the border crisis to protect the American people, which is why I chose this as the first bill [Laken Riley Act] the Senate will vote on this Congress.”

The Senate will likely vote on the legislation as early as this Friday, the DCNF has learned.

The House of Representatives is also slated to vote this week on companion legislation sponsored by Georgia Republican Rep. Mike Collins that would also target illegal migrants who commit theft-related crimes.

The bills seek to honor the memory of Laken Riley, a University of Georgia nursing student who was murdered by an illegal migrant while out on a run near her college campus in February 2024. Riley’s killer, Venezuelan national Jose Antonio Ibarra, had a criminal record in the United States prior to killing Riley and was convicted of murdering the 22 year-old college student in November 2024.

Ibarra and his brother were previously arrested in October 2022 for allegedly shoplifting at a Walmart in Athens, Georgia, but were ultimately released because the shoplifting charge was a misdemeanor.

If the legislation up for consideration in the House and Senate passes both chambers and is signed into law by President-elect Donald Trump, federal immigration authorities would be required to detain illegal migrants like Ibarra who commit theft-related crimes in the United States.

The Trump-Vance transition team did not immediately respond to the DCNF’s inquiry about whether Trump would sign the legislation cracking down on illegal migrant criminals into law.

Six Dems Vote In Favor Of Resolution Bashing Biden And ‘Border Czar’ Harris’ Failures

Six House Democrats voted in favor of a resolution condemning President Joe Biden’s administration and Vice President Kamala Harris for their “failure to secure the United States border” on Thursday.

H. Res. 1371 was introduced by Republican Rep. Elise Stefanik to formally condemn “Border Czar” Harris’ immigration policy after she was tasked with reducing illegal immigration over the southern border early in the Biden administration. The resolution passed the House with 196 Democrats voting against it and six Democrats joining 214 Republicans in favor of it.

Democratic Reps. Marie Gluesenkamp Perez of Washington, Mary Sattler Peltola of Alaska, Jared Golden of Maine, Donald Davis of North Carolina, Henry Cuellar of Texas and Yadira Caraveo of Colorado, voted in favor of the resolution.

The resolution was cosponsored by Republican Reps. Neal Dunn of Florida, Greg Lopez of Colorado and Mike Bost of Illinois.

“Kamala Harris, every elected Democrat, and their stenographers in the mainstream media will run from their record, but they can’t hide,” Stefanik said in a post on X. “House Republicans will hold Kamala Harris accountable for her role as Biden’s Border Czar leading to the most catastrophic border crisis in modern history.”

The Biden-Harris administration has overseen record influxes of illegal immigration. Since Biden took office, Customs and Border Protection (CBP) has encountered nearly eight million migrants, with over 83,000 encounters between ports of entry along the southern border in June alone, according to CBP data.

During former President Donald Trump’s term, every month saw fewer encounters on the southern border compared to June 2024 numbers, with some exceptions in fiscal year 2019, according to CBP data.

The House resolution highlights Harris’ dismal immigration track record, pointing out that it took the “Border Czar” over 90 days on the job before she finally made her way to the southern border on June 25, 2021. The resolution also pointed out the surges in violent crime that have occurred due to the illegal immigration that has taken place under Harris’ watch.

The resolution brought attention to the innocent Americans like Laken RileyJocelyn Nungaray and Rachel Morin. All three women were allegedly murdered by illegal immigrants.

“Kamala Harris failed as Border czar leading to violent crimes, rapes, and murders of innocent Americans,” Stefanik said in a statement on X. “We will hold her and Far Left Democrats accountable.”

Georgia Adopts Legislation to Strengthen Anti-Sanctuary Laws in Wake of Laken Riley’s Murder

The Georgia Legislature took a significant step towards improving public safety last week by passing the Georgia Criminal Alien Track and Report Act of 2024 (HB 1105) and sending it to Governor Brian Kemp’s desk. If signed into law, HB 1105 will put teeth into Georgia’s anti-sanctuary law to ensure criminal aliens operating in Georgia communities are not shielded from immigration enforcement.

HB 1105 requires Georgia’s local law enforcement agencies to cooperate in the enforcement of federal immigration laws by honoring of detainer requests. The bill also imposes penalties for sheriff’s offices and jailers who refuse to participate in ICE’s 287(g) program. If found violating HB 1105, the locality will lose state and federal funding.

The Senate chamber was filled with drama as debate on the bill came to a close. Laken Riley’s parents entered the Senate chamber for the final vote and her father, Jason Riley, stepped towards the podium to speak. Mr. Riley urged Senators take action. “God gave me a beautiful daughter to father, protect, provide for, and nurture. A man with an evil heart stole her life. He was in this country and in this state illegally. My vision for every senator in this chamber is that you protect citizens from this illegal invasion.”

Despite being considered a common-sense measure by most, some Georgia lawmakers opposed the bill. Senator Nabilah Islam Parkes, (D-Duluth), suggested the bill will negatively impact all immigrants. She suggested the bill was designed to punish victims of crimes “whose only connection to the crime is share[ing] the [same] immigration status of the perpetrator,” rendering them “collateral damage” to immigration enforcement efforts.

However, Senator John Albers (R), the bill’s sponsor, spoke on the tragic nature of Laken’s death, saying, “This could have been prevented. I hope laws like this and other things that are happening will prevent future tragedies from happening.”

Tragically, Laken Riley became the collateral damage of the Biden administration’s open-border policies and Athens-Clarke County’s sanctuary policies. And it took Laken’s murder to focus Georgia lawmakers on the dangerous impact open borders and sanctuary policies have on public safety. Equally distressing is the fact that Laken’s death isn’t an isolated incident but rather one of a few that has garnered national media attention. According to Representative Jesse Petrea (R-166), a co-sponsor of HB 1105, nearly 200 convicted murderers are classified as illegal aliens within Georgia’s prison system. “There’s 182 today, so my point is to say Laken Riley wasn’t the first. it’s high-profile. It’s horrible. Remember this: Every single violent crime committed against someone by someone illegally in the country was and is an avoidable crime.”

While HB 1105 cannot undo the tragic loss of Laken and the other victims of illegal alien crime, it stands as a crucial measure in condemning the actions of her murderer and safeguarding the community against future acts of violence. This bill is expected to be signed by Governor Kemp. When remarking on Laken’s death, Governor Kemp said, “This is a failure of our system on multiple levels, and at multiple times, and it has resulted in a young woman’s death. That is inexcusable.”

Trump Meets Family Of Laken Riley At Georgia Rally

Former President Donald Trump met the family of Laken Riley Saturday night at a Georgia campaign rally.

Trump was photographed embracing members of the murdered nursing student’s family before taking the stage in Rome, located right outside of Atlanta, according to the New York Post. Riley’s body was found late February near a lake at the University of Georgia (UGA) campus after she was allegedly beaten to death by an illegal migrant.

The prospective Republican presidential nominee’s campaign distributed posters of Riley’s photo with phrases like “Say her name” and “Remember our angels” written on them, ABC News reported.

Trump tore into President Joe Biden for incorrectly saying Riley’s name Thursday during his 2024 State of The Union address, blaming the Democratic president’s policies for Riley’s murder. Biden called the deceased 22-year-old “Lincoln” instead of Laken after being heckled by Republican Georgia Rep. Marjorie Taylor Greene to “say her name.”

“He’s got no remorse, he’s got no regret. He’s got no empathy,” Trump said of Biden. “No compassion, and worst of all, he has no intention of stopping the deadly invasion that stole precious Laken’s beautiful, American life.”

Allyson Phillips, the mother of the late Riley, criticized Biden in a Facebook comment. She wrote, “Biden does not even KNOW my child’s name — it’s pathetic! If you are going to say her name (even when forced to do so) at least say the right name!”

Biden apologized Saturday for referring to Riley’s alleged murderer as “an illegal” during his State of The Union speech, saying that he should have used the term “undocumented” instead. Biden told MSNBC’s Jonathan Capehart that unlike Trump, he didn’t want to “treat any of these people with disrespect.”

The Venezuelan migrant charged with murdering Laken Riley has been identified as member of a deadly gang, but was still waved through the US border, sources have revealed.

Jose Ibarra, 26, is listed as part of the deadly Tren de Aragua gang on internal Department of Homeland Security documents seen by The Post.

He was first arrested for illegally crossing into the US in September 2022 at El Paso, Texas. However, after less than 24 hours in custody, he was released on parole and given free rein in the US until October 2024, according to Immigration and Customs Enforcement insiders.

Houses Passes ‘Laken Riley Act’ To Crack Down On Illegal Immigrant Criminals

The House passed a bill Thursday that would target illegal migrants in the U.S. who have committed certain crimes, naming the legislation in memory of the late nursing student Laken Hope Riley.

Riley, aged 22, was killed on Feb. 22 after being allegedly attacked while running in a forested area near the University of Georgia (UGA) in Athens, Georgia, with the suspect arrested and charged with her murder, Jose Antonio Ibarra, being a Venezuelan national who allegedly entered the United States illegally and was released after being initially detained. The Laken Riley Act would require the federal government to detain foreign nationals who commit “burglary, theft, larceny, or [a] shoplifting offense” as well as grant states to sue the federal government for non-enforcement of certain aspects of immigration law, and passed the House by a vote of 251 yeas to 170 nays.

“It that should pass the Senate. That doesn’t mean it will or it would, but it should. This is common sense legislation. This is good legislation, and this can help our local law enforcement so I would hope that the Senate would look at it from that standpoint,” Republican Rep. Mike Collins of Georgia, the bill’s sponsor, who represents the district where Riley died, told the DCNF. “There’s nothing wrong with this bill. There’s nothing I could see that they could point at and say ‘That’s wrong,’ with this bill. And if we can pass this, we should pass it. It’s got a good chance of helping save a life.”

“Laken Riley is not here with us anymore because of Biden’s failed policies. It’s about border security more than immigration. So, we need to look at what can we do if he is not going to secure the border,” Republican Rep. Barry Loudermilk of Georgia told the DCNF. “Her murderer was arrested in New York City weeks before and was released. Why shouldn’t he have been deported at that moment, by committing a crime?”

“Jose Ibarra, a 26-year-old citizen of Venezuela, was arrested by U.S. Customs and Border Protection (CBP) on Sept. 8, 2022, after unlawfully entering the United States near El Paso, Texas. He was paroled and released for further processing,” ICE spokesperson Lindsay Williams told the DCNF. “On Aug. 31, 2023, Ibarra was arrested by the New York Police Department and charged with acting in a manner to injure a child less than 17 and a motor vehicle license violation. He was released by the NYPD before a detainer could be issued,” Williams added.

The bill was passed shortly before Biden visited the U.S. Capitol to deliver the annual State of the Union address.

“This is a young lady who was just…with everything that we’ve learned about her, [she] just had a great future, a wonderful young lady who was dedicating herself to being a nurse, to help people,” Republican Rep. Earl “Buddy” Carter of Georgia told the DCNF. “Don’t think that this is the only incident there are other incidents, as well…Every city is a border city. Now, every state is a border state.”

Senate Majority Leader Chuck Schumer and the White House did not immediately respond to a request for comment.

Affidavit reveals Migrant charged with murdering Laken Riley BEAT HER SO BADLY, he disfigured her skull…

The Venezuelan illegal implicated in the homicide of Laken Riley is accused of inflicting such severe injuries with an unrecognizable instrument that her skull was disfigured, recent affidavits claim.

26-year-old Jose Antonio Ibarra, who is facing a series of charges including murder and assault, is believed to have had no prior acquaintance with the 22-year-old nursing student. He allegedly abducted and murdered her during her jog on the University of Georgia campus on Thursday.

Initially, her death was attributed to blunt force trauma, but newly filed legal documents allege that Ibarra inflicted “severe physical harm with an object,” though the exact nature of the object has not been disclosed.

Additionally, Ibarra has been charged with aggravated battery for causing serious disfigurement to her body, specifically to her skull.

Jose Antonio Ibarra was arrested on Friday for allegedly kidnapping and killing the 22-year-old Augusta University junior, UGA Police Chief Jeffrey Clark told reporters at a press conference Friday night.

Ibarra was not a UGA student and is not a US Citizen, Clark said.

He and Riley had no prior relationship.

“He did not know her at all. I think this is a crime of opportunity where he saw an individual and bad things happened,” Clark said.

Ibarra is a Venezuelan national who illegally crossed the southern border into El Paso, Texas in September 2022, News Nation reported, citing multiple DHS sources. He was released from DHS custody over a lack of detention space, according to the outlet.

Riley, a dean’s list student and sorority member, was found dead with “visible injuries” in a wooded area near Lake Herrick around 12:38 p.m. Thursday.

Clark confirmed Friday that she died of “blunt force trauma.”
Her alleged killer, Jose Antonio Ibarra, was arrested and charged in the killing on Friday.

Ibarra’s apartment in Athens was being searched by authorities while Clark spoke, but he said police had enough evidence to charge him before the search warrant was executed.

“The evidence is robust. It is supported by key input by the community, physical evidence and expert police work. Importantly, we were assisted by video footage from our campus security cameras network,” Clark said.

Three or four persons of interest had been questioned but only Ibaira was charged.
