DANGER ZONES: ICE List of Counties harboring Illegal Aliens includes Alachua County, Florida

Breitbart’s Ben Kew in his column Trump Publishes 1st List of ‘Sanctuary Cities’ Protecting Illegal Aliens reports:

In an attempt to increase pressure on sanctuary cities, the Department of Homeland Security has published its first weekly list of all 118 localities refusing to cooperate with the Trump administration’s immigration crackdown.

Each week, the list will publish every detention request rejected by local jails — detailing the relevant agency, the status of the immigrant, and the charges they are facing.

The first report was published this Monday, listing 206 cases in which illegal aliens were arrested and consequently released from jail without charge, despite recommendations from the Immigration and Crime Enforcement agency (ICE) to detain them for at least 48 hours.

The cases listed took place between January 28th to February 3rd, Donald Trump’s second week in office.

In his executive order signed January 25th designed to properly enforce immigration policy, Trump said regular lists were necessary to better inform the public “regarding the public safety threats associated with sanctuary jurisdictions.”

Well San Francisco has nothing over the Sunshine State. Florida is home to seven “sanctuary counties.” The sanctuary counties are: Pasco, Hillsborough, Pinellas, Hernando, Miami-Dade, Broward and Palm Beach.

These counties are perfectly located along Florida’s East and West coast lines to allow illegal felons, like Francisco Sanchez, to enter with ease.

Harboring illegal aliens is wrong and endangers Florida’s citizens. Alachua County is now another danger zone in the Sunshine state.

Alachua County Sheriff Sadie Darnell has a constitutional duty to uphold the laws of the State of Florida and federal laws concerning illegal alien detention. Not to do so is simply wrong.

If Sheriff Darnell can break the law then anyone can.

Congressman Lou Barletta’s Bill to Defund Sanctuary Cities — Getting the new year off to a great start

Time and again our elected political “representatives” on all levels of government have acted in ways that failed to truly represent the best interests of America and Americans.

Time and again my articles have focused on my frustration and anger over how all too many politicians have obstructed the effective enforcement of our nation’s immigration laws.

I have written extensively about how members of Congress who supported so-called, “Comprehensive Immigration Reform” blithely ignored the findings and, indeed, warnings about the 9/11 Commission by concocting legislation that would provide unknown millions of illegal aliens with official identity documents and lawful status even though there would be no way to conduct interviews or field investigations to screen to combat immigration fraud.  Visa fraud and immigration benefit fraud were identified as key entry and embedding tactics of international terrorists.

“Sanctuary Cities” created by rogue mayors operate in direct opposition of Title 8 U.S. Code § 1324 – (Bringing in and harboring certain aliens), an immigration criminal statute that address harboring, shielding, aiding and abetting, encouraging and inducing aliens to enter the United States illegally and/or remain in the United States illegally after entry.

Today, however, we have cause to be optimistic.  Congressman Lou Barletta who truly represents the citizens of his home town of Hazleton, Pennsylvania and, in so doing, all Americans from coast to coast and border to border has, for the third time, introduced legislation that would strip all federal funding from cities that fail to cooperate fully with immigration law enforcement activities.

I am proud that Lou has become a personal friend.

Prior to his election to Congress he was the mayor of Hazleton.  He was shocked when his peaceful town was, for lack of a better term, invaded by a violent Dominican narcotics-trafficking gang that engaged in drug dealing and violent crimes including murder.

Although he approached the administration of President George W. Bush and asked for federal assistance in confronting these illegal criminal aliens, the administration refused to help.  As a consequence he promulgated the first ordinances that penalized employers who knowingly hired illegal aliens and landlords who would knowingly provide housing to illegal aliens.

He was promptly sued in federal court by advocates for illegal aliens.  I was his final witness at the trial that ensued.

Lou was first elected to Congress in 2011.  He is currently a member of several committees including:

Lou is certainly an asset to those committees and to America.

On September 3, 2013 I joined Congressman Lou Barletta on the campus of Embry-Riddle Aeronautical University tat a town hall meeting, covered by C-SPAN, on the topic of “Immigration Policy and Homeland Security.”

The video of the town hall event is well worth watching.  During our discussion, Lou clearly articulated his concerns about how failures of immigration law enforcement have cost all too many innocent victims their lives and leave America and Americans vulnerable to terrorism and crime.

On January 5, 2017 Lou posted a press release with the clear title,  “Barletta’s 1st Bill Of 115th Congress: Defund Sanctuary Cities.”

Here is how Lou’s press release begins:

WASHINGTON Congressman Lou Barletta (PA-11) today introduced the Mobilizing Against Sanctuary Cities Act, H.R. 83, which will stop all federal funds from flowing to states or localities which resist or ban enforcement of federal immigration laws, or flatly refuse to cooperate with immigration officials.  The bill is the first piece of legislation introduced by Barletta in the 115th Congress and represents the third time the congressman has introduced the measure.  In 2011, the bill was the first piece of legislation he ever introduced as a member of Congress.  He introduced it a second time in the 114th Congress in 2015.

“One of the principal duties of the government is to protect its citizens, and the idea of sanctuary cities runs completely counter to that responsibility,” Barletta said.  “Too many mayors and local governments think that they are above federal law and place their own ideology ahead of the safety of their residents.  This bill will stop that practice by saying to these sanctuary cities, ‘If you refuse to cooperate with federal immigration enforcement, you will lose your federal funding.’”

Barletta introduced the bill as a freshman congressman in 2011 because of his personal experience with the danger of sanctuary cities while he was mayor of Hazleton, Pennsylvania.  In 2006, a 29-year-old local father of three, Derek Kichline, was murdered by an illegal immigrant who had been released by law enforcement a number of times, including by the sanctuary city of New York.  Additionally, Barletta was spurred to reintroduce the bill in 2015 following the San Francisco murder of 32-year-old Kate Steinle, whose accused killer was a seven-time felon who had been deported five times previously.

Although the Obama administration has paid lip service to speak against sanctuary cities, the Obama administration has virtually turned the United States into a “Sanctuary Country” litigating against Arizona and taking other adverse actions against those who would enforce our immigration laws while releasing tens of thousands of criminal aliens who subsequently committed more crimes including homicides and violent assaults.

President-elect Trump made effective immigration law enforcement the cornerstone of his election campaign.  Donald Trump promised he would end Sanctuary Cities, putting the lives of innocent people ahead of the lives of illegal aliens and, in particular, criminal aliens who have been responsible for massive levels of carnage and violence on the streets of American cities.

While Obama would never sign the legislation that Lou proposed in the past, it is a near certainty that Trump would be eager to sign that bill into law thereby helping the soon-to-be president achieve one of his first goals.

All that would remain would be for Congress to pass Lou’s important bill to get it to President Trump’s desk after January 20th.

It is important that you reach out to your member of Congress and insist that he/she supports this vital legislation.

‘Sanctuary Cities’ vs National Security and Public Safety

Why ‘sanctuary city’ mayors should be given an MVP Award by ISIS and drug cartels.

The lunacy of the immigration executive orders and other actions of the Obama administration to block the enforcement of our immigration laws and immigration anarchy will be brought to a screeching halt on the day that Donald Trump replaces Mr. Obama in the Oval Office.

However the “Immigration All-Clear” will not be sounded across the United States in cities and states that have been declared “Sanctuaries” by the mayors and governors who have created a false and very dangerous narrative that equates immigration law enforcement with racism and bigotry.

This insidious false claim has been heartily embraced by the demonstrators who are rampaging across the United States to protest the election of Donald Trump and his promises to secure the U.S./Mexican border and enforce our immigration laws.

This is the false narrative that has enabled mayors of so-called “Sanctuary Cities” to foist this lunacy on the residents of their cities and was the focus of my article, “Terrorism, Enclaves and Sanctuary Cities: How sanctuary cities facilitate the growth of terror enclaves in America.”

The challenge for the Trump administration and for all Americans, is to eliminate these enclaves of lawlessness.

Sanctuary cities are highly attractive to illegal aliens and the criminals, fugitives and likely terrorists among them who entered the United States by evading the inspections process conducted at ports of entry by the CBP (Customs and Border Protection) inspectors and are vulnerable to arrest and removal (deportation).

Sanctuary cities, however, certainly do not provide “sanctuary” for the residents of those cities who, all too often, fall victim to the crimes committed by these criminal aliens.  However, what is generally not understood is that Sanctuary Cities endanger every person in the United States, no matter where they live.

Terrorists would most likely seek to set up shop in sanctuary cities to evade detection and arrest.

They can use the security provided by such “leaders” as Chicago’s Rahm Emanuel and New York’s Bill de Blasio as a staging area for attacks they might carry out in the cities where they live or in other cities they could easily travel to on the day of an attack.

While politicians from both parties often claim that the “Immigration system is broken” as a way of justifying their positions of advocacy for massive amnesty programs and the creation of these dangerous “sanctuaries” for criminals, fugitives and terrorists, in reality, this is “Immigration Failure — By Design.”

America’s borders and immigration laws are our first line of defense and last line of defense against international terrorists, transnational criminals, fugitives from justice and those foreign nationals who would displace American workers wrecking havoc on the lives of those Americans and their families when they lose their jobs and their paychecks.

A quick review of a section of the Immigration and Nationality Act (INA)- Title 8, United States Code, Section 1182 would quickly dispel the bogus claim that equates the enforcement of our immigration laws with racism.

That section of law enumerates the categories of aliens who are to be excluded. Among these classes of aliens who are to be prevented from entering the United States are aliens who suffer from dangerous communicable, diseases or extreme mental illness.

Additionally, convicted felons, human rights violators, war criminals, terrorists and spies are to be excluded as well as aliens who would seek unlawful employment thus displacing American workers or driving down the wages of American workers who are similarly employed and aliens who would likely become public charges.

It is vital to note that our immigration laws make absolutely no distinction in any way, shape of form as to the race, religion or ethnicity of any alien.

The Joint Terrorism Task Force (JTTF) is a multi-agency federal task force that operates under the aegis of the FBI.  While, as might be expected, the FBI contributes the greatest number of enforcement personnel to that effort, the second largest contingent of agents assigned to the JTTF are special agents of  Immigration and Customs Enforcement / Homeland Security Investigations (ICE/HSI).

The majority of international terrorists also commit immigration law violations including visa fraud, immigration benefit fraud and a list of other crimes which include immigration law violations.

To provide you with such an example, consider my commentary, “Immigration Fraud Linked To San Bernardino Jihadist’s Family: Alleged supplier of material support now also charged with marriage fraud.”

This quote from the official report, “9/11 and  Terrorist Travel” identifies the nexus between systemic failures of the immigration system and vulnerability to terror attacks in the United States.

Thus, abuse of the immigration system and a lack of interior immigration enforcement were unwittingly working together to support terrorist activity. It would remain largely unknown, since no agency of the United States government analyzed terrorist travel patterns until after 9/11. This lack of attention meant that critical opportunities to disrupt terrorist travel and, therefore, deadly terrorist operations were missed.

That quote also underscores the importance of enforcing our immigration laws from within the interior of the United States and how failures of such efforts create deadly vulnerabilities for the United States.  This concern was the focus of my recent article, “Immigration and the Terrorist Threat: How our leaders are spawning catastrophe.”

As an INS agent I investigated and arrested aliens from countries from around the world.  My colleagues and I did not single out violators of immigration laws on the basis of race, religion or ethnicity.

For about three years I was assigned as the Marine Intelligence Officer for the INS New York District Office.  I was responsible for joining members of the Coast Guard and U.S. Customs in boarding ships in and around the New York City area to search for contraband, stow-ways and ship-jumpers (crew members who absconded and failed to return to their vessels before they departed from the United States.)

While such vessels provided individuals from many countries the opportunity to gain illegal access to the United States, the majority of crew members who went “missing” were citizens of Greece.

As part of my duties I was responsible for tracking down those aliens wherever they lived and worked and took the into custody to arrange for their deportation from the United States.

Members of the Greek community frequently complained to me that the INS was only concerned about Greeks.

When I worked on several investigations concerning organized crime, we often heard members of the Italian immigrant community complain that we were targeting Italians.

When we partnered with the Public Morals Division of the NYPD to raid brothels to shut down those locations in China Town, local resident grumbled about how unfair this was to the Asian community.

In reality the “targeting” that we did at the INS involved law violators irrespective of race, religion or ethnicity.

Period.

However, because of the utterly false and irresponsible Orwellian narrative created by the open borders immigration anarchists, incredibly, many gullible and misinformed Americans have been conned into believing that opposing fair and effective enforcement of our immigration laws is an act of heroism and a way of fighting prejudice and bigotry.

On November 14, 2016 NPR reported, “Mayor Rahm Emanuel: ‘Chicago Always Will Be A Sanctuary City’.”

That report began with the following paragraphs:

Chicago Mayor Rahm Emanuel added his voice to the chorus of big-city mayors who say theirs will remain “sanctuary cities” in response to President-elect Donald Trump’s hard-line positions on illegal immigration.

Surrounded by immigration activists, business leaders and state and federal lawmakers, Emanuel sought to reduce the fear of immigrants living in this country without authorization.

“To all those who are, after Tuesday’s election, very nervous and filled with anxiety … you are safe in Chicago, you are secure in Chicago and you are supported in Chicago,” said Emanuel at a news conference called to publicize the expansion of mental health services for people anxious over the election results.

“Chicago has in the past been a sanctuary city. … It always will be a sanctuary city,” the mayor said.

His comments come on the heels of Trump’s appearance Sunday on CBS’s 60 Minutes, in which the president-elect promised to deport all immigrants with criminal records.

You would imagine that the mayor of any town would be thrilled to have criminal aliens deported to end the concern of recidivism and keep the residents of those cities safe.

Many mayors do see things that way and support cooperative efforts between their police departments and ICE.

However, the mayors of “Sanctuary Cities” and the governors of Sanctuary States have “done the math” and have, unbelievably decided that achieving political objectives is far more important than protecting innocent lives and the security of our nation.

Such politicians must not find “sanctuary” in the voting booth come their election day.

For The Confused Media: A Dummy’s Guide To Immigration And Refugee Problems

With the Syrian (so-called) refugee crisis ubiquitous in the headlines, the media has found itself dealing with immigration issues on a daily basis.  Unfortunately, extreme confusion abounds.  The media’s total inability to draw basic distinctions regarding immigration to the United States, both legal and illegal is harming the public’s ability to digest this important topic.  Immigration terms are being thrown around print media, radio, and television that have no relation to the real facts or existing laws.

The following is the dummy’s guide to some of the most important distinctions regarding legal and illegal immigration to the United States.  It is sincerely hoped that this will help to end the erroneous reasons and multitude of excuses offered by the media on a daily, almost hourly, basis.

Legal Immigration

Visas

  • Visa Waiver Program: For travel and business purposes, this allows visitors to the United States from other specified countries to enter the country without obtaining a visa (based upon reciprocity). There were 38 Visa Waiver countries as of January 2009.  Applicants fill out an application via us.  (Note: Israel is not one of those 38 countries, yet Americans can enter Israel without obtaining a visa.)
  • Common Visas:
    • K1: For foreign fiancés of Americans. These visas are often abused by foreigners who seek citizenship, and will bribe “fiancés” whom they have no intention of marrying.
    • K-3: For foreign spouses of Americans.
    • H-1B: For skilled foreign workers. American employers must prove that the foreigner’s qualifications are not readily available domestically.
    • F and M: Academic/student visas. See below for common abuses of student visas.

Legal Immigrants

  • Green Cards: Holders of Green Cards must not be outside the United States for more than 5 months and 29 days per year. They must also have a legal record.  After five years, they are eligible to apply for citizenship.  At that time, they must also indicate all the countries they have visited in the previous five years.

Illegal Immigration

  • Border crossings: Today, the nation’s two borders (south and north) are equivalent to Swiss cheese. The Border Patrol has been handicapped by the Obama administration.  By definition, we know nothing (no names, no photos, no fingerprints) about illegal immigrants who cross our borders unannounced and unchallenged.  In the worst case scenario, an illegal immigrant who is caught inside the country will be ordered to leave within 15 days.  Against all logic, no check is applied to make sure that he does in fact leave!
    • If a person returns to the country illegally after being deported for previously entering illegally, by law that person has committed a felony and should be arrested, sentenced, and jailed.
  • Visa overstays: Other than border crossings, many foreigners are in the country illegally because they overstay their visas. For example, student visas are routinely abused in this manner.  Why?
    • After they are issued, there is no check to ensure that the student is enrolled at the college/university. They may never show up to begin with, or drop out after one, two, or three years.
    • After their study program is over, there is no check to ensure that they leave the country as expected.

Refugees

Refugees should not be considered a part of the immigration system, legal or illegal.  The Refugee Resettlement program is administered by the federal government (U.S. Department of State) and the United Nations.  In the U.S., the program is managed by politically-connected NGO’s (including many who are connected to the Catholic Church), and who receive money per refugee they process.

  • Security screenings: The White House claims that each refugee goes through multiple levels of security screenings, including the FBI, DHS, and State Department. However, FBI Director James Comey has warned that “certain gaps” remain in the screening process.

Sanctuary Cities

According to the Center for Immigration Studies, “Across the U.S., there are 340 cities, counties, and states that are considered “sanctuary cities”.  These jurisdiction[s] protect criminal aliens from deportation by refusing to comply with ICE detainers or otherwise impede open communication and information exchanges between their employees or officers and federal immigration agents.”

In other words, these are cities, counties, and states where existing federal law is intentionally ignored by local authorities.  For a map of these places, click here.

Conclusion

The entry checks for immigrants are sophisticated (ten-finger prints, pictures, and names).  But there are no checks whatsoeverregarding their exit.  Therefore, it is impossible to provide accurate figures on overstays, illegal entries, etc.

The American immigration system is abused through both legal and illegal channels.  Because of the complexity of the issue, the media regularly confuses and/or conflates the problems associated with the system.  Despite the challenges and complexities, the laws already exist to enforce immigration and ensure the integrity of the system, and in turn keep Americans safe.  Special time and effort should be dedicated to develop and implement accurate and feasible exit procedures.
