Why Isn’t Florida State Attorney Ed Brodsky Doing His Job?

On September 1st, 2023 we sent the letter below to our Florida State Attorney Ed Brodsky asking him to empanel a grand jury to look into high crimes and misdemeanors perpetuated by Joseph Robinette Biden, Jr. and his administration.

Ed Brodsky
Office of the State Attorney, 12th Judicial Circuit
Criminal Justice Building, Suite 400
Sarasota, Florida 34237

Dear State Attorney Brodsky,

Before entering your current office, you took the following oath:

I do solemnly swear (or affirm) that I will support, protect, and defend the Constitution and Government of the United States and of the State of Florida.

This letter is to apprise you of egregious violations against the Constitutions of the United States of America and the State of Florida by Joseph Robinette Biden, Jr., his family, and members of his importuning putative administration.

These violations include the crimes of bribery, extortion, murder, collusion, election interference, treason, seditious conspiracy, deprivation of rights under color of law, and more.

Other State Attorneys and District Attorneys have contacted Congressman James Comer (R-KY) to obtain the necessary grounds and evidence to empanel grand juries to prosecute the above and other crimes by said individuals. Congressman Comer may be reached at his Washington, D.C. office at (202) 225-3115.

We have attached documents that provide information on your authority and a sample charge sheet with evidence sufficient to empanel a grand jury to convene and determine if it is reasonable to prosecute each of these criminal acts, including treason.

We ask that you do your duty to restore equal justice under the law and reinstate the American people’s confidence in the justice and judicial systems, by arresting and prosecuting these offenders, in what amounts to an unprecedented coup d’état and pernicious attack upon our Republic, the several States and the American People.

Kindly, please advise your intentions.

Sincerely,

[Signed]

Richard M. Swier

On September 6th, 2023 we received a letter from Mr. Brodsky’s office stating, “We are in receipt of your letter dated September 1, 2023. After reviewing the information provided, the referenced statues are federal in nature. Unfortunately, this office does not handle federal charges. Please contact the U.S. Attorney’s Office and ask to have them review your documents for possible federal charges. I have returned all the documents our office received so you can forward them to the U.S. Attorney’s Office for their review.”  The letter was signed by Craig J. Schaeffer, Chief Assistant State Attorney.

After receiving this letter we took two actions.

  1. We responded to Mr. Brodsky (see letter below) outlining the relevant U.S. Codes that give him the power to empanel a grand jury and look into high crimes and misdemeanors perpetuated by Joseph Robinett Biden, Jr. and his administration against the people of Florida
  2. We sent a letter with attachments to The Honorable Roger B. Handberg, U.S. Attorney, Middle District of Florida. Click here to read our take action letter.

Dear State Attorney Brodsky,

I received a letter dated September 6, 2023, from Craig J. Schaeffer, Chief Assistant State Attorney in reply to my letter to you asking that you empanel a grand jury to look into high crimes and misdemeanors perpetrated against the people of Florida.

Mr. Schaeffer stated the following in his letter:

“We are in receipt of your letter dated September 1, 2023. After reviewing the information provided, the referenced statutes are federal in nature. Unfortunately, this office does not handle federal charges.

In the Attorney Brief that was sent to your office, and reviewed by Mr. Schaefer, were these two important legal references that clearly indicate Mr. Schaeffer is wrong in his assessment of your jurisdiction in empaneling a grand jury.

Article VI of the U.S. Constitution states:

This Constitution, and the Laws of the United States which shall be made in Pursuance thereof; and all Treaties made, or which shall be made, under the Authority of the United States, shall be the supreme Law of the Land; and the Judges in every State shall be bound thereby, any Thing in the Constitution or Laws of any State to the Contrary notwithstanding.

The Senators and Representatives before mentioned, and the Members of the several State Legislatures, and all executive and judicial Officers, both of the United States and of the several States, shall be bound by Oath or Affirmation, to support this Constitution.

Federally Protected Activities – 18 USC § 245 states:

(a)(1) Nothing in this section shall be construed as indicating an intent on the part of Congress to prevent any State, any possession or Commonwealth of the United States, or the District of Columbia, from exercising jurisdiction over any offense over which it would have jurisdiction in the absence of this section, nor shall anything in this section be construed as depriving State and local law enforcement authorities of responsibility for prosecuting acts that may be violations of this section and that are violations of State and local law.

The Attorney Brief and Sample Charge sheet clearly outline violations of 18 USC § 245 which you and Mr. Schaeffer, as local law enforcement authorities are responsible for prosecuting as they do, in fact, violate state and local laws.

Among these local and state laws that have been violated is the human trafficking of minor immigrant children for the purpose of prostitution into the State of Florida as proven by Attorney General Ashly Moody’s statewide grand jury. You may wish to contact AG Moody’s office to obtain the full findings of that grand jury in furtherance of doing your duty, as you and Mr. Schaeffer swore to do under oath, and bring justice to those who have been harmed.

Additionally, I ask you to reconsider your role in this matter and reply at your earliest convenience to explain why Mr. Schaeffer is not doing his duty and the role that he, as my Chief Assistant State Attorney, is required by law to perform.

I await your reply.

Sincerely,

[Signed]

Dr. Richard M. Swier, Ed.D.

Lieutenant Colonel, U.S. Army (Ret.)

We will report on any reply we receive to our 2nd letter to Mr. Brodsky.

We hope that this time Mr. Brodsky actually understands his role in prosecuting individuals who have committed high crimes and misdemeanors against we the people of Florida.
