Supreme Court Agrees To Hear Trump’s Appeal Of Decision Removing Him From Colorado Ballot

The Supreme Court agreed to hear former President Donald Trump’s appeal to the Colorado Supreme Court’s decision to kick him off the state’s ballot.

The Colorado Supreme Court ruled Dec. 19 that Trump is ineligible to be on the state’s primary ballot under Section 3 of the 14th Amendment. The Supreme Court set oral arguments to consider Trump’s appeal for Feb. 8, 2024.

Trump appealed the ruling to the Supreme Court on Wednesday. The Colorado Republican Party previously filed a separate appeal Dec. 27.

“The question of eligibility to serve as President of the United States is properly reserved for Congress, not the state courts, to consider and decide,” Trump’s petition stated. “By considering the question of President Trump’s eligibility and barring him from the ballot, the Colorado Supreme Court arrogated Congress’ authority.”

Section 3 of the 14th Amendment prevents individuals who took an oath to the Constitution and then engaged in insurrection from holding office.

Trump’s brief, along with any other friend-of-the-court briefs, must be filed by Jan. 18. The respondent’s brief is due by Jan. 31, and Trump’s reply brief is due by Feb. 5, according to the Court’s order.

Twenty-seven states filed an amicus brief Friday urging the Supreme Court to reverse the Colorado ruling.

The Colorado Supreme Court acknowledged that they traveled in “uncharted territory” when it issued the decision in December.

“The sum of these parts is this: President Trump is disqualified from holding the office of President under Section Three; because he is disqualified, it would be a wrongful act under the Election Code for the Secretary to list him as a candidate on the presidential primary ballot,” the Colorado Supreme Court wrote in its opinon.

Maine Secretary of State Shenna Bellows also issued a ruling Dec. 28 finding Trump was ineligible to appear on the state’s ballot, which he appealed Tuesday.

Trump did not immediately respond to a request for comment.

POLL: Most Americans Trust Elections Less If Results Take ‘Days Or Weeks’

Americans are less likely to trust the fairness and accuracy of an election if results take “days or weeks” to be counted, according to a new poll.

When asked if results that took “days or weeks” to tabulated were more or less trustworthy, 33.9% of respondents said that it is “much less likely,” and 20.9% said that it is “somewhat less likely,” according to the Trafalgar Group/Convention of States Action poll. Across party lines, 62.7% of Republicans, 27% of independents, and 10.4% of Democrats said that they were “much less likely” to trust results that took “days or weeks” to tabulate. 

“The majority of Americans are now skeptical about the outcomes of elections, which creates a fundamental problem that—if left unchecked—could undermine our entire democracy,” President of the Convention of States Mark Meckler said in a statement.

Many states experienced delays in ballot tabulation following the 2022 midterm elections, as election centers struggled to count votes that were received in the mail following Election Day. Arizona, California, Maine, Alaska, Nevada and Colorado continued to count ballots over a week past the midterm elections, as many of the states allowed mail in ballots, postmarked by election day, to arrive by Nov. 15.

However, when asked about election fairness and accuracy, the majority of respondents at least somewhat trusted election results. Of 1,084 respondents, 21.9% of respondents said that they “strongly distrust” election results, with 17.9% saying they “somewhat distrust” them, according to the poll.

Before the midterm elections, election integrity was a leading priority for voters, according to Rasmussen Reports. Of likely voters, 84% would be a major issue in the midterm elections.

“The answer does not lie in Washington, DC, this problem can and must be fixed close to home. State legislatures need to make strengthening election integrity priority number one, and governors need to focus on vigorous enforcement. Until we get the problem under control, this needs to be treated as the state-by-state emergency that it is,” Meckler continued.

The poll was conducted from Nov. 16 to Nov. 20 with a margin of error of 2.9%.

‘We Must Decertify the Election’: Trump Issues Fiery Response to Audit Bombshells

Donald Trump reacted to the preliminary findings of the independent election audit team that testified in an update to the Arizona Senate on Thursday.

“Arizona Senate hearings on the Maricopa County Election Audit is devastating news to the Radical Left Democrats and the Biden administration,” Trump said.

“While this, according to the Senate is preliminary, with results being announced at a later date, it seems that 74,234 Mail-in Ballots were counted with ‘no clear record’ of them being send,” he added. “There were 18,000 voters who were scrubbed from the voter rolls AFTER the election.”

“They also revealed that the voting system was breached or hacked (by who?),” he added. “Very big printer and ballot problems with different paper used, etc. and MUCH MORE.”

“This highly respected State Senator Wendy Rogers said in a tweet this hearing today means we must decertify the election,” Trump said. “In any event, the Senate patriots are moving forward with final results to be announced in the not-too-distant future, but based on today’s hearing, why even wait?”

Arizona Republican State Sen. Wendy Rogers is calling for “the Biden electors to be recalled to Arizona” and demanding that a “new election must be conducted” following explosive news this week.

Following the audit hearing in Maricopa County, Rogers is calling for Joe Biden’s electors from Arizona to be recalled and for the state to hold a new election.

Cyber Ninjas CEO Doug Logan testified on Thursday that the auditors reported 74,000 ballots that were received and included in the 2020 Election in Maricopa County than were mailed out.

Logan said they found 74,243 mail-in ballots with no clear record of them ever being sent.

“We have 74,243 mail-in ballots where there is no clear record of them being sent,” Doug Logan said. “And so we have 74,000 where we have them came back from individuals where we don’t have a clear indication that they were ever sent out to them.”

Logan stated that the standard of verification for mail-in ballots dropped considerably as the volume of the ballots increased.

Logan claimed that Maricopa County is withholding mail-in ballot images that can be used as evidence.

Logan also said there were 11,326 individuals who did not show up on the version of the voter rolls prepared the day after the election but did show up on the Dec. 4 list as not only being registered but having voted.

And he said there were nearly 4,000 people listed as registering to vote after the cutoff on Oct. 15.
