IMMIGRATION: President Trump’s Revised EO is Constitutional, Legal, and Common Sense

President Trump has signed a revised Executive Order (EO) on immigration and refugee resettlement. Democrats are already calling it a “Muslim ban.” A question that Democrats should ask themselves: What if former President Clinton had banned the 9/11/2001 hijackers from entering the United States, would we be better off today?

Secretary of Homeland Security John Kelly released the following statement about the EO:

“The Executive Order signed today by President Trump will make America safer, and address long-overdue concerns about the security of our immigration system. We must undertake a rigorous review of our visa and refugee vetting programs to increase our confidence in the entry decisions we make for visitors and immigrants to the United States. We cannot risk the prospect of malevolent actors using our immigration system to take American lives.

The Executive Order signed today is prospective in nature—applying only to foreign nationals outside of the United States who do not have a valid visa. It is important to note that nothing in this executive order affects current lawful permanent residents or persons with current authorization to enter our country. If you have a current valid visa to travel, we welcome you. But unregulated, unvetted travel is not a universal privilege, especially when national security is at stake.

“The Department of Homeland Security has worked closely with the Department of Justice, the Department of State, and the White House to create an executive order that addresses our information concerns while protecting the homeland and our citizens.”

Hans von Spakovsky in his The Daily Signal article “Why Trump’s Revised Executive Order Is Constitutional, Legal, and Common Sense” writes:

President Donald Trump’s revised executive order restricting travel from terrorist safe havens is just as constitutional and legal as his original order, despite what some courts such as the 9th U.S. Circuit Court of Appeals said about the original order.

But the revisions he has made, which clarify that the executive order does not apply to any foreigners who already hold visas to enter the U.S., will make it tougher for activist judges to justify any injunction orders they might be inclined to issue against it. Yet there is little doubt that progressive groups will seek such orders.

The executive order, “Protecting the Nation from Foreign Terrorist Entry into the United States,” confirms what the administration had previously announced, which is that the temporary, 90-day suspension of entry into the U.S. from certain designated countries will not apply to:

  • Lawful permanent residents as well as diplomatic, NATO, and U.N. personnel.
  • Foreign nationals admitted after the effective date of the executive order.
  • Individuals with a visa valid on the date of the executive order.
  • Dual nationals travelling on a passport issued by a non-designated country.
  • Individuals already granted asylum or refugee status before the effective date of the executive order.

This is an important revision because it voids the due process concerns that the 9th Circuit expressed—namely, that individuals who had already received approval to enter or reside in the United States might have that right taken away from them without a review and appeal process.

Spakovsky concludes, “This executive order is clearly within the president’s authority under 8 U.S.C. § 1182 (f), in which Congress clearly delegated to the president the authority to suspend the entry of any aliens into the U.S. when he believes it would be ‘detrimental to the interests of the United States’.”

The clincher to this story is in the last sentence.  570 “dangerous” refugees are being watched.  Surely they could get rid of them before they commit a terrorist act!

I’m guessing that Chancellor of Germany Angela Merkel is trying to look tough in the lead-up to German elections this year.

And, how many more are still unknown to them?

German police arrested two migrants from Syria and one from Bosnia on Thursday in Dusseldorf. The arrest was for alleged war crimes in war-torn Syria, including the mass murder of three dozen civilians back in 2013.

Federal prosecutors said that 35-year-old Syrian refugee, Abdalfatah H. A., a suspected member of the Al-Qaida linked Al-Nusra Front is accused of 36 counts of war crimes for executing 36 Syrian government employees in 2013.

Another Syrian refugee, 26-year-old Abdulrahman A. A., also a member of the Al-Nusra Front is accused of handling the funds, vehicles and weapons for one of the combat units of the jihadist group.

On a separate arrest, the southern state of Bavaria said that authorities have arrested a 33-year-old Bosnian, who was suspected of suppling vehicles to the Sunni militia, Janud al-Sham.

German Federal prosecutors have launched about a dozen investigations on war crimes committed in Syria and Iraq, as well as multiple cases of refugees being suspected of membership to jihadist groups.

Germany’s population of Islamic extremists has risen from 100 individuals in 2013, it had swell to 1,600 in a span of four years. The German security and intelligence agency (BfV) said that they are keeping close tabs on about 570 individuals who they consider as ‘dangerous’ and are capable of orchestrating terror attacks.

‘Drain the Swamp’ Promise Drives Establishment Panic

I’m consistently asked this question by bewildered Republicans and Trump supporters: Why won’t Democrats give President Trump a chance? He was duly elected and yet the attacks began immediately. Why? There was an election and Trump won. Give him a chance.

It’s a reasonable question. And the answer is the perfect confluence of dynamics propelling this phenomena of immediate and historically intense opposition.

First, we need to understand that the response by Democrats, the media and the reactionary, organized and funded street Left, needs to be seen through the prism of why Trump was elected in the first place.

Trump’s campaign and election is a repudiation in every conceivable way of Obama’s policies, many of Bush’s policies and Congress’ game-playing. Many Americans did mediocre under Bush, and most did poorly under Obama. The reasons for which are a different topic, but they fall under the broadest umbrella of “The way Washington does things.” And the way Washington does things is to put Washington interests first. Not Americans’.

Trump tapped into those frustrations and angers at Washington, and into substantial American anxiety over the country’s direction and slow demise. The anger of Trump supporters was largely not race-based. Not immigrant-based. Obviously not gender-based.

It was Washington-based.

The swamp today

Washington is a well-oiled machine — for Washington interests.

The power structure within Washington — the most important, wealthy and powerful capitol in the world — is this: Politicians, beginning with the President and Congress; political appointees, starting with Cabinet members, then their deputies and so on; lobbyists, who are often former members of Congress and former political appointees (that’s the revolving door Trump is trying to close); and finally, the entrenched bureaucracy that makes a solid living by the tens of thousands, often accomplishing little more than self-perpetuating. The leaks damaging to Trump and appointees is coming from this final group.

The Washington metro area never suffered through the long recession and economic downturn that the rest of the country did. It never does. Because the billions of dollars — trillions, actually — just keep pouring into the Capitol.

This is the swamp that hundreds of thousands of Trump supporters chanted about at his campaign stops across the country.

When Trump was elected, he immediately set about keeping the promises he made over and over on the campaign trail. Draining would commence. That in itself is shocking, as it has long been accepted — by the media and “smart” circles, not so much the rest of America — that Republicans and Democrats alike say a lot of things during a campaign to get elected that we all know — wink, wink — they do not intend to act on.

This is the bait and switch. Clinton was never going to provide a middle class tax cut. Bush was never going to cut entitlements. Obama was never going to block gay marriage. The media knows it and is part of the act.

This Beltway acceptance of lying to the American people in “campaign mode” reflects the elite’s expectation that the masses are stupid enough to not see it during governing mode. That’s also how Washington works. But the people saw it, and found someone they believed would do what he said. The results are in. Trump is setting about the draining.

Rapid response

The establishment of both parties was rocked on their keisters by Trump’s election. His campaign mode is the same as his governing mode in terms of doing what he said he would. His quick actions on promises to start undoing the Washington that does not work for most Americans was like poking a mama grizzly in her den with her cubs.

Reaction was swift, from demonstrations without to leaks from within. The small minority of Republicans publicly opposing Trump gave cover to Democrats to go to unexplored extremes, beyond the normal political oppositions all presidents naturally face from the opposing party.

Because of Trump’s own careless linguistic excesses and thin skin, he provides continual fodder for the masses of the angry Left that was being used by the organized, funded elements of the Left.

Remember, these were people who were sure they were going to get the first woman president and losing to such an upstart apple cart over-turner was enraging. The demonstration organizers and funders are able to take that anger and frustration of the Left and use it to leverage their existing infrastructure of protesting machines. While many people in the demonstrations are sincerely upset, they are being used by the Left establishment.

So this impressive array came together: The Democrat establishment, just a small but cover-providing portion of the Republican establishment, the media establishment that Trump continues to engage head-on like no one else, the entrenched bureaucratic establishment (including the intelligence agencies) and ancillary establishments of lobbyists, experts, etc. They aligned in common cause against the man that most seems to threatened the system that has empowered and enriched them.

Trump is a highly imperfect vehicle for this undertaking, but this same array would have come together against any candidate who truly meant to “drain the swamp.” Trump just makes it a little easier with his public carelessness.

If Trump is allowed to do what he says he wants to do, it becomes the first loosening of the plug at the bottom of the swamp. A lot of political oxes will be gored, power and influence will be lost and cozy D.C. establishments on the Left and Right will be up-ended.

They won’t wait to see how he does because it is not in their best interests to do so, and they seem to have all the components in place to not wait.

Seismic change: Tuesday’s address to Congress

Key phrase being “seem to.”

This is vital, because Trump presented a dramatically different image of himself when he address the Joint Session of Congress Tuesday night — a State of the Union for a newly elected president. In it, Trump laid out a vision for the country that was not sifted through the heavy filter of media bias and negativity.

Trump was presidential, controlled, focused on his vision and agenda, compassionate and patriotic. He hit 80 percent conservative notes, 20 percent populist notes. The reviews even in the media were that Trump not only gave a great speech — because expectations are low with him on giving speeches — but a well above-average speech for any State of the Union or equivalent. It was a real effort at post-partisanship (to which the Democrats in attendance gave the metaphorical middle finger) and a forceful vision of a renewed America.

Even his fiercest enemies, such as Van Jones, said: “He became President of the United States in that moment, period.”

So if Trump not only does exactly what he promised to do in terms of the broadest “drain the swamp” actions, but does it with more of the gravitas expected of the office, then the Washington establishment will have two options: dig in deeper and ratchet up or give up and surrender.

There is no reason to think they will easily surrender their power, influence and wealth.

Under President Trump refugee arrivals to the U.S. have dramatically slowed

In advance of a new EO supposedly coming out on Wednesday, checking the numbers this morning here are a few things I learned.

Total arrivals this fiscal year (which began on October 1, 2016) are at 36,822.  Last time we checked on 2/23 we were at 36,637.

Secretary of State Tillerson and President Trump can still set the ceiling lower than 50,000!

President Trump has set the ceiling for this fiscal year which ends on September 30th at 50,000 (a number we argue is not that low when one examines all of the post 9/11 years, see here. Bush’s lowest year was 39,554).

47% of the 36,822 are Muslim refugees of some stripe.

Here is how they break down:

Ahmadiyya: 130
Shiite: 2,152
Sunni: 8,659

Muslim (who apparently don’t designate a sect): 6,547

A couple of things that interested me in the numbers.  First we are bringing in large numbers of Burmese Muslims now (Rohingya, I presume).  817 are recorded as from Burma.  In reality we don’t know exactly where they came from.  They could be from the Muslim country of Bangladesh.  These are not our responsibility!

Then for Iraqis we admitted both sides of the warring factions:  1,472 are Shiites and 2,506 are Sunnis.

So, let me get this straight! From Iraq we must have Sunnis saying they are persecuted by Shiites and Shittes saying they are persecuted by Sunnis, and we bring them both to be resettled in your cities.  How long before they go after each other on American soil?

So here (from Wrapsnet) is a map of where the 36,822 were placed one day short of 5 months in to FY2017.

Wyoming remains the only state in the nation with no refugee program.  Of course Washington, DC only gets a tiny number.

Here are the top ten receiving states. 

I repeat! Governor Abbott’s withdrawal of the state of Texas from the UN/US Refugee Admissions Program did not slow the flow to the state! If you want to help President Trump succeed, Texans need to focus their political activism on Senator John Cornyn as we explained here.

Mayor of Honolulu: My Latest Appointee Helped Deliver Lots of Muslims to Europe

honolulu sealA February 21, 2017 Caldwell administration news release touting the appointment of Jim Howe to head the Honolulu Emergency Services Department includes this tidbit:

“Most recently, Howe provided consulting services to the ProActiva Open Arms program, which helps rescue European-bound refugees from treacherous ocean waters who are fleeing war, persecution or poverty.”

“ProActiva Open Arms” sounds humanitarian but some in Europe see it as a human trafficking scheme run by mercenaries and intelligence operatives intended to keep refugees from overrunning tiny Malta.  The Guardian May 3, 2016 explains: “The Maltese immigration crisis is a decade ahead of the rest of Europe. It began in 2002, during the fierce fighting of the Somali civil war, peaked in 2004 when Malta joined the EU, and ended – eerily, abruptly, and so far without a decent explanation – just as the main European crisis was beginning in 2015.”

Some Trump supporters see the hijrah as a George Soros funded plan to destabilize Europe which backfired leading to the election of nationalists—including Donald Trump—in country after country throughout the West.

Here is the rundown on ProActiva, and its ships Golfo Azuro and Astral, from anti-EU European think-tank GEFIRA:

GEFIRA December 4, 2016: NGOs are smuggling immigrants into Europe on an industrial scale

For two months, using marinetraffic.com, we have been monitoring the movements of ships owned by a couple of NGOs. Using data from data.unhcr.org., we have kept track of the daily arrivals of African immigrants in Italy. It turned out we were witness to a big scam and an illegal human traffic operation.

NGOs, smugglers, the mafia in cahoots with the European Union have shipped thousands of illegals into Europe under the pretext of rescuing people, assisted by the Italian coast guard which coordinated their activities.

Human traffickers contact the Italian coast guard in advance to receive support and to pick up their dubious cargo. NGO ships are directed to the “rescue spot” even as those to be rescued are still in Libya. The 15 ships that we observed are owned or leased by NGOs have regularly been seen to leave their Italian ports, head south, stop short of reaching the Libyan coast, pick up their human cargo, and take course back 260 miles to Italy even though the port of Zarzis in Tunis is just 60 miles away from the rescue spot.

The organizations in question are: MOAS, Jugend Rettet, Stichting Bootvluchting, Médecins Sans Frontières, Save the Children, Proactiva Open Arms, Sea-Watch.org, Sea-Eye and Life Boat.

The real intention of the people behind the NGOs is not clear. We would not be surprised if their motive were money. They may also be politically driven; the activities of the Malta-based organisation, MOAS, by trafficking people to Italy is the best guarantee that migrants will not show up on the Maltese shore. MOAS is managed by an Maltese Marine officer well known in Malta for his maltreatment of refugees 1)

GEFIRA November 15, 2016: Caught in the act: NGOs deal in migrant smuggling

On the evening of 12 October at 21:15, 113 people were picked up 8.5 nautical miles off the Libyan Mellitah Complex, by four NGO ships; the Phoenix, the Astral, the Iuventa and the Golfo Azzurro. At that moment these four ships were within the territorial waters of Libya.

During this transport, 17 persons were reported missing, including a three-year-old child.

Wednesday 12 October eight o’clock in the morning, the Italian coast guard informed the Golfo Azzurro about the coming “rescue” operation, 10 to 12 hours in advance; they directed the Golfo Azzurro to a location within the Libyan territorial waters. Eveline Rethmeier, a Dutch journalist, was on board of the Golfo Azzurro. At 20:23 (UTC time 18:23) she posted a video were ‘Chief of the Mission’ Mateo told the crew something was coming. In her blog she wrote: “At eight o’clock in the morning we got the messages that there is a ship with problems 30 nautical miles away from us. The Italian coast guard asked assistance in the area. We were briefed by ‘Chief of the Mission’ Mateo. He told us that we should be prepared for guests.”

The Italian coast guard did not only direct the Golfo Azzurro to the Libyan territorial waters but also the Phoenix, the Astral and the Iuventa. According to the Malta Today: “It was around 7 pm (12 October) when the Maritime Rescue Coordination Centre in Rome contacted Phoenix. Still, it was only at 9.20pm that the rubber boat was sighted by making use of the Schiebel drones on board the Phoenix. In cooperation with the other search-and-rescue NGOs in the area, a rescue operation was swiftly launched.” The Golfo Azzurro was told at 8.00 AM that there was a ship with problems while the Phoenix was contacted 10 to 11 hours later!

Virginia Governor Terry McAuliffe, vetoes Refugee Reporting Bill

Bills like these are really innocuous.  They don’t stop any refugee placement in the state, they simply tell state officials and the public who is in the state. The information would aide local officials in determining school capacity, housing availability and other welfare services that would need to be provided to these legal immigrants.

RICHMOND, Va. (NEWSPLEX) — A bill requiring an annual report on refugees resettled in Virginia has been vetoed.

Governor Terry McAuliffe vetoed House Bill 2002 on Friday, saying the report would “send a message of exclusion to people looking for the chance to rebuild their lives” and poses a danger to them.

The legislation would have required nonprofit resettlement agencies and local affiliates that provide refugee or other immigrant resettlement services, like the International Rescue Committee, to report information regarding those settled in the Commonwealth.

The state Department of Social Services would then collate and submit a report to the governor’s office and the General Assembly each year.

The report would include information such as the total number of individuals resettled in Virginia by the agency; the locality where the individual was resettled; the individual’s age, gender and nation of origin; and whether the individual was placed through the U.S. Refugee Resettlement Program.

It would be interesting to see if Maryland Republican Governor Larry Hogan would veto a similar bill! Hogan has spoken in favor of more refugees for Maryland.

My name is Shabnam Assadollahi. I am a resident of Orleans, a taxpayer who was born a Muslim in Iran and immigrated to Canada in 1991.

I heard that the City of Ottawa might consider to vote that Ottawa becoming a “Sanctuary” City. Please allow me to express my disapproval and grave concerns about this suggestion.

As an immigrant and former political child prisoner of notorious Evin prison by the Islamic regime of Iran and international award winning Human Rights Advocate, I have no issues with Ottawa welcoming immigrants and refugees, as long as they are here legally and Canada takes in numbers that we can readily accommodate. As a professional working on a daily basis with refugees and newcomers, I hear their devastation by this so called “open-border” policy of Canada. Every immigrant and newcomer I have spoken to strongly believes in upholding the rule of law and in maintaining national security and they are so fearful about their families safety and security. It is also very important for our nation’s capital to set an example by following the law, for example, by having our police forces cooperate with Border Services in immigration-related areas.

I recently watched a video by a U.S. Immigration expert, (please click on this link), who spoke of the U.S. immigration experience and the effect of having large numbers of illegal immigrants on the economy, on crime, on drugs, on wages and so on. I was left with very deep concern about the implications of living next door to the U.S. at a time when the U.S. Government is deporting illegal immigrants from the U.S., if they have a criminal record or if they are terror suspects. I expect that we will see increasing numbers of these people streaming across the Canadian borders to avoid being deported to Mexico or elsewhere, and as a nation do we really want these people living in Canada? As more Canadian cities consider becoming sanctuary cities, based on the U.S. experience, our Canadian cities may have difficulty absorbing these people, with not enough jobs for them, increasing crimes, lower wages, etc. As a hardworking taxpaying Ottawa resident, having senior parents living alone who are frustrated by this scary news, I would be extremely disappointed to see it happen.

Have you examined what is happening in European countries as a result of the huge influx of immigrants they are receiving? Those nations are weekly experiencing chaotic events, riots, murders, and rapes. Although media has been encouraged by the European Union not to associate crime with Islamic immigration, the truth is that 500% increases in rape, for example, are related to those coming from Islamic majority counties. President Donald Trump is acting to protect America based on these examples, and it is my professional opinion he is very prudent and discerning. It has already been proven that the vast majority of immigrants are not even the women and children we might out of compassion hope to help. Often, young, strong males are coming, and they are a restless bunch! Remember the old saying, “Idle hands are the devil’s playground?” For many Europeans, they are learning the meaning of this first hand, are suffering much, and are very unhappy. It is, in fact, inspiring uprisings.

Do we want civil war on the streets of Canada?

When it is more cost effective for world leaders to find less expensive means to care for immigrants in the Middle East, ask the American President, until they can resettle back in their homeland, and when those restless men believe unveiled women are free game sex slaves, no joke, it makes total sense to keep them in the Middle East. There are plenty of YouTube videos (Not Fake News) made by people who are documenting the insanity in their countries. It would be an awful shame for the women of Canada to have to dye their hair black and where chastity underwear like girls in Sweden do. That would be on your hands if you freely open our doors to a huge influx of immigrants.

Are we a country seeking to please the European Union, or a biased United Nations? Or, are we interested in preserving our people and our majestic country? Cars set aflame through the streets of our cities does not sound desirable.

I know how welcoming Canadians are—and indeed we are! But, we also have to be wise protecting this country and our peaceful and beautiful cities we live in. I hope that you agree with me and five members of my family and vote against this dangerous suggestion. Thank you in advance for your consideration.

Japan holds firm, admits only TINY number of refugees

I haven’t written about Japan for awhile, and since we have so many new readers, I figured it was time to point this out (again)—Japan only takes a tiny number of refugees!

And, consequently, the UN High Commissioner for Refugees has been haranguing Japan for years to open its doors (and begin diluting their culture!) to the masses of Middle Eastern and African (mostly Muslim) migrants on the move around the world.  Japan has resisted.

And I have not seen the UNHCR harangue China, Saudi Arabia or some other Middle Eastern countries in the same way they nag Japan.

Here is an activist from the UK badmouthing Japan’s Prime Minister Shinzo Abe, at The Diplomat:

When asked for his view on the U.S. president’s executive order to ban the entry of people from seven Muslim-majority countries in the Middle East and Africa, Japanese Prime Minister Shinzo Abe’s response was very disappointing.“We are not in a position to express the view of the Japanese government,” he said at the Upper House on January 30. Not surprisingly, he did not bring up the travel ban’s issue when he met President Donald Trump earlier this month.

In contrast to the clear disagreement with the travel ban expressed by other world leaders, the Japanese leader’s response received criticism from the opposition and civil society. Many theorized that the prime minister had avoided criticizing the new U.S. president in order to protect Japan’s national interests, in particular its economy and security. Yet others pointed out a more fundamental problem: Japan cannot point its finger at any other country’s immigration policy.

Japan’s record on immigration and refugees is not something that the country can be proud of. In 2016, Japan granted refugee status to only 28 people out of 10,901 applicants. In other words, 99 percent of applications were rejected.

It is not enough for the nags that Japan is one of the world’s top contributors to the UNHCR:

Japan is one of the top donors to the UN Refugee Agency (UNCHR). It contributed $164,726,114 in 2016, making Japan the fourth largest donor after the United States, European Union, and Germany. Yet instead of turning this generosity to welcome refugees on its soil, Japan crosses its arms to those who actually arrive on its doorstep. On January 30, when discussing the U.S. travel ban, Abe added after his response, “At any rate, we believe the international community should jointly cope with refugee issues.”

So far, Japan’s leadership is smart enough to look around the world and ask—why should we invite the problems we see in Sweden, Germany, France, The Netherlands and the US to our tiny country?

Champagne Time! It’s a ‘Bloodbath’ at the State Department

“It’s a bloodbath at the State Department,” the New York Post hyperventilated last Friday: “Secretary of State Rex Tillerson is cleaning house at the State Department, according to a report.” In Donald Trump’s America, so much has happened so quickly to set the nation on a course decisively different from the one it was on during the regime of his disastrous socialist internationalist predecessor that this particular bit of good news was largely overlooked. But if a housecleaning at the State Department isn’t a cause for celebration, nothing is.

“Many of those let go were on the building’s seventh floor — top-floor bigs,” the Post tells us, and adds that this is “a symbolically important sign to the rest of the diplomatic corps that their new boss has different priorities than the last one.”

Pop the champagne!

And not only that, but “this week’s round of firings marks the second time State Department personnel have been cleared out since President Trump took office last month. Four top officials were cleared out of the building at the end of January.”

Break out the hats and hooters!

We can only hope that with the departure of these failed State Department officials, their failed policies will be swept out along with them. Chief among these is the almost universally held idea that poverty causes terrorism. The United States has wasted uncounted (literally, because a great deal of it was in untraceable bags full of cash) billions of dollars in Afghanistan, Iraq, Pakistan, Egypt, and other countries in the wrongheaded assumption that Muslims turn to jihad because they lack economic opportunities and education. American officials built schools and hospitals, thinking that they were winning over the hearts and minds of the locals.

Fifteen years, thousands of lives and hundreds of billions of dollars later, no significant number of hearts and minds have been won. This is partly because the premise is wrong. The New York Times reported in March that “not long after the attacks of Sept. 11, 2001…Alan B. Krueger, the Princeton economist, tested the widespread assumption that poverty was a key factor in the making of a terrorist. Mr. Krueger’s analysis of economic figures, polls, and data on suicide bombers and hate groups found no link between economic distress and terrorism.”

CNS News noted in September 2013 that “according to a Rand Corporation report on counterterrorism, prepared for the Office of the Secretary of Defense in 2009, ‘Terrorists are not particularly impoverished, uneducated, or afflicted by mental disease. Demographically, their most important characteristic is normalcy (within their environment). Terrorist leaders actually tend to come from relatively privileged backgrounds.’ One of the authors of the RAND report, Darcy Noricks, also found that according to a number of academic studies, ‘Terrorists turn out to be more rather than less educated than the general population.’”

Yet the analysis that poverty causes terrorism has been applied and reapplied and reapplied again. The swamp is in dire need of draining, and in other ways as well. From 2011 on, it was official Obama administration policy to deny any connection between Islam and terrorism. This came as a result of an October 19, 2011 letter from Farhana Khera of Muslim Advocates to John Brennan, who was then the Assistant to the President on National Security for Homeland Security and Counter Terrorism, and later served in the Obama administration as head of the CIA. The letter was signed not just by Khera, but by the leaders of virtually all the significant Islamic groups in the United States: 57 Muslim, Arab, and South Asian organizations, many with ties to Hamas and the Muslim Brotherhood, including the Council on American-Islamic Relations (CAIR), the Islamic Society of North America (ISNA), the Muslim American Society (MAS), the Islamic Circle of North America (ICNA), Islamic Relief USA; and the Muslim Public Affairs Council (MPAC).

The letter denounced what it characterized as U.S. government agencies’ “use of biased, false and highly offensive training materials about Muslims and Islam.” Despite the factual accuracy of the material about which they were complaining, the Muslim groups demanded that the task force “purge all federal government training materials of biased materials”; “implement a mandatory re-training program for FBI agents, U.S. Army officers, and all federal, state and local law enforcement who have been subjected to biased training”; and moreto ensure that all that law enforcement officials would learn about Islam and jihad would be what the signatories wanted them to learn.

Numerous books and presentations that gave a perfectly accurate view of Islam and jihad were removed from coounterterror training. Today, even with Trump as President, this entrenched policy of the U.S. government remains, and ensures that all too many jihadists simply cannot be identified as risks, since the officials are bound as a matter of policy to ignore what in saner times would be taken as warning signs. Trump and Tillerson must reverse this. Trump has spoken often about the threat from “radical Islamic terrorism”; he must follow through and remove the prohibitions on allowing agents to study and understand the motivating ideology behind the jihad threat.

The swamp needs draining indeed. The “bloodbath” at the State Department is a good sign that the U.S. is on its way back on dry land.

All they needed to do to save Europe from invasion was to turn back just a couple of boats

….but it is too late.

Here is a long story at Bloomberg Businessweek that you don’t have to read. It is an overly-long, detailed account of the travails of a Somali migrant (is he even telling the truth?) being trafficked in to Europe.

The invasion began in earnest when Obama and Hillary destabilized Libya opening the best migrant launchpad ever available on the coast of North Africa.  (I have many posts here on Hillary and Libya).

In 2015, then Australian Prime Minister Tony Abbott told the Europeans what they must do.  They didn’t listen!

He said to begin (safely) turning boats back to the African coast.  It would only take a few returns to derail the network of traffickers making millions by moving Africans to Europe.

I can’t believe that we might see the end of Europe as a bulwark of western civilization even in my lifetime (and I am old!), my children will certainly see it!

In my opinion, only two paragraphs matter in this long Bloomberg piece that followed the route of one Somali star of the story. Here they are:

At last, one night in the spring of 2015, some men moved him to a rubber boat on the beach. With a hundred other people, he moved out onto the darkened Mediterranean. “We were on the water for 16 hours,” he said. One migrant carried a satellite phone and called an Italian number when the boat started to leak. “Then we were rescued by the Italian Coast Guard,” said Ahmed.

The rescue ships on the Mediterranean—the U.S. Coast Guard, NGO vessels, Eunavfor frigates—try to give some comfort to the people they scoop from the sea. They offer thin, warm stew and a quick medical checkup before delivering them to an Italian port. Ahmed arrived in Sicily in about March 2015. He’s still there, at the CARA Mineo refugee camp, waiting for European asylum.

The traffickers know how to get the invaders ‘rescued.’

I didn’t know that the US Coast Guard was involved in the European invasion, but, if so, it’s time for Trump to pull them back.

Today there is a sob story about how some of the refugees expected to be resettled in Delaware by the Hebrew Immigrant Aid Society (HIAS) might not be coming. Longtime readers know that Delaware has only received a handful of refugees over the years and I have always suspected that somehow good ol’ might have had a hand in keeping the numbers small (not in my backyard!).

But, near the end of the Delaware news we see that the HIAS is a plaintiff in at least one of the lawsuits against the Trump Administration and I thought it might be a good idea to show you their complaints which seem to center around the idea that they were promised so many refugees (paying clients) this fiscal year and now they might not get them.

Right on cue! Immigrant riots break out in Sweden

Although such crime and riots are not new to us, apparently a very large number of liberals (and some Republicans too!) did not know that Sweden was so close to the edge.

But actually of greater interest than the fact that this latest violence seemed to break out on cue after Donald Trump commented Saturday on the trouble Sweden was having with Muslim migrants, is the fact that CNN this morning actually reported on it!

Here is CNN:

Stockholm, Sweden (CNN)Riots broke out in a predominantly immigrant neighborhood of Stockholm Monday night, as residents clashed with police officers and set vehicles on fire, Swedish police say.

Officers were forced to call in reinforcements when a crowd began to gather in the suburb of Rinkeby during the arrest of a suspect, according to a statement from Stockholm police.

Stockholm regional police chief Ulf Johansson said the clashes may have been a result of their “increased pressure on criminals in the area.”

The clashes come days after US President Donald Trump suggested that immigrants in Sweden were to blame for an increase in crime across the country.

In recent years, Sweden has taken in more refugees per capita than any other European country, which has fueled tensions and caused a rise in anti-immigrant sentiment.

In 2013, large scale riots flared for a week in the Swedish capital, with gangs setting fire to schools and a police station.

In 2015, more than 160,000 people — many from Iraq, Syria and Afghanistan — arrived in Sweden seeking asylum.

The country granted asylum to 101,025 refugees — about 1% of the total population — from 2012 to 2015.

CNN, however, can’t let go of two things.  One, there is a brief mention of the high unemployment rate of the migrants. No kidding! So how on earth does the Swedish government think they are going to afford tens of thousands of restless young Middle Eastern men? (Call it Sweden’s suicide wish!)

These migrants are also dumb or they would be reading the news, have restrained themselves for a few weeks, and not have given Trump a victory.

And, CNN could not resist quoting some Swedes laughing at Donald Trump who deny that anything is amiss even in the face of overwhelming evidence that they have a problem.

Invasion of Europe news…..

Everyone talks about France and Germany, but, for years, my money has been on Sweden as the first country to fall to the tide of overwhelming Muslim migration.

If you don’t know what Trump said at his rally in Florida on Saturday, look it up. He did not say Sweden had a terrorist attack.  In fact, what is happening to Sweden is worse than a one-off Islamic terror incident. Mass Muslim migration is taking down the whole taxpayer-supported safety net, and ultimately (I don’t see how they get out of it) Sweden, as we know it, will not exist.

When the Muslim population reaches a critical level, their supremacism kicks in! (Hijra!)

For a British boy to be killed by a grenade attack anywhere is appalling, but for it to happen in a suburb of Gothenburg should shatter a few illusions about Sweden. Last week’s murder of eight-year-old Yuusuf Warsame fits a pattern that Swedes have come slowly to recognise over the years. He was from Birmingham, visiting relatives, and was caught up in what Swedish police believe is a gang war within the Somali community. Last year, a four-year-old girl was killed by a car bomb outside Gothenburg, another apparent victim of gang violence.

For years, Sweden has regarded itself as a ‘humanitarian superpower’ — making its mark on the world not by fighting wars but by offering shelter to war’s victims. Refugees have arrived here in extraordinary numbers. Over the past 15 years, some 650,000 asylum-seekers made their way to Sweden. Of the 163,000 who arrived last year, 32,000 were granted asylum. Sweden accepts more refugees in proportion to size of population than any other nation in the developed world — when it comes to offering shelter, no one does it better. But when it comes to integrating those we take in (or finding the extra housing, schools and healthcare needed for them), we don’t do so well.
It may be news to the rest of the world, but gang warfare has been a feature of our country for years now.

‘If you are not prepared, you are unprepared.’ These are the words of Fredrik Reinfeldt, our former prime minister, and perfectly sum up Sweden’s migration crisis. We still hear politicians defiantly claim that our country is a humanitarian superpower — but they don’t do so as often, and they sound distinctly less smug when they do. The Swedish Way might not shine quite as brightly as a beacon to the world. But anyone who wants to find out how not to handle a migration crisis is welcome to pay us a visit.

I disagree with one point here, “politicians” do not deserve all the blame, it was the naive Swedes themselves, after all, who voted these ‘leaders’ in to office!

Trump’s Immigration EOs and the Constitution: Thumbs up or thumbs down?

President Trump has stated that he plans to modify and re-issue his executive order concerning his executive order to suspend the entry of aliens into the United States who are citizens of countries that have a nexus to terrorism and where the citizens of those countries cannot be properly vetted to prevent terrorists from entering the United States.

It will be interesting to see what the new executive order will contain.  I am certain that Attorney General Jeff Sessions will be able to devise a “new and improved” executive order.  However, I am still struggling to understand how the first order ran into any problems.

Those opposed to President Trump’s executive orders on immigration have freely and frequently invoked the claim that those executive orders are “unconstitutional.”

Although many politicians, pundits and journalists have made that claim on a string of news programs on the major networks, they have rarely, if ever, been challenged to explain how the President’s executive orders violate the Constitution.

Usually when making their fatuous claims about the “unconstitutionality” of the immigration executive orders, they cite the First Amendment of the Constitution and the issue of religious freedom.

What has been generally glossed over was the fact that the executive order did not mention any religion, let alone Islam.  However, inasmuch the seven countries identified in the executive order as being “Muslim majority countries” the illusion was created that President Trump was attempting to bar the entry of Muslims into the United States.

What was also ignored by the media is that the list had been compiled by the Obama administration.

What has additionally been ignored is that in 1980 President Carter suspended the entry of citizens of Iran into the United States when our embassy at Tehran was seized.

If Trump’s goal was to bar the entry of Muslims into the United States he was incredibly inept.  In fact, if that was his goal, he should have added the world’s most populist Muslim majority nation, Indonesia, to that list of countries inasmuch as its population is nearly as great as the combined population of all of the seven countries on that list.

The seven countries are countries that have a nexus to international terrorism.  As was the case in 1980, the entry of citizens of Iran into the United States was to be suspended.

Yet these issues are seldom noted in the mainstream media.

In this era of “Asymmetrical Warfare” the Commander-In-Chief must not only protect America and Americans from foreign governments and their military but from international terrorist organizations.

Consider that on September 11, 2001 nineteen terrorists, barely out of their teens inflicted more casualties on the United States than did the entire Japanese fleet at Pearl Harbor on December 7, 1941.

Now let’s consider that Article IV, Section 4 of the U.S. Constitution states:

The United States shall guarantee to every state in this union a republican form of government, and shall protect each of them against invasion; and on application of the legislature, or of the executive (when the legislature cannot be convened) against domestic violence.

Invasion has been defined as:

an instance of invading a country or region with an armed force: the Allied invasion of Normandy | in 1546 England had to be defended from invasion.

  • an incursion by a large number of people or things into a place or sphere of activity: stadium guards are preparing for another invasion of fans.
  • an unwelcome intrusion into another’s domain

As for the expression, “domestic violence,” deadly terror attacks certainly inflict devastating domestic violence.

I would suggest that a failure of the President of the United States to act to prevent the entry and embedding of foreign terrorists into the United States would constitute nonfeasance, misfeasance and malfeasance.  Indeed, I would argue it would constitute gross negligence of duty.

Furthermore the Immigration and Nationality Act (INA) includes this statute: 8 U.S. Code § 1182 – Inadmissible aliens which includes section (f) Suspension of entry or imposition of restrictions by President.  That section includes the following paragraph:

Whenever the President finds that the entry of any aliens or of any class of aliens into the United States would be detrimental to the interests of the United States, he may by proclamation, and for such period as he shall deem necessary, suspend the entry of all aliens or any class of aliens as immigrants or nonimmigrants, or impose on the entry of aliens any restrictions he may deem to be appropriate.

It is clear that the President of the United States may act unilaterally if he finds that the entry of any alien or class of aliens would be detrimental to the interests of the United States.  The phrase “detrimental to the interests of the United States” creates an extremely low bar.  Threats to national security certainly exceed the minimal standard of being “detrimental to the interests of the United States.”  Time and again innocent people in the United States have been killed and grievously injured by foreign terrorists who managed to game the visa process and the process by which aliens are granted various immigration benefits including being granted political asylum, lawful immigrant status and even, in a few instances, United States citizenship.

Our European allies have similarly suffered deadly terror attacks when their immigration systems failed.  I provided specific examples and parallels of this in my recent article, “Berlin Terror Attack and Immigration Law Violations: What America should learn from this newest horrific lesson.

Clearly President Trump has learned the lessons of these terror attacks and on January 27, 2017 he issued another executive order that has drawn scant attention by the media.

The title of this executive order, “Protecting The Nation From Foreign Terrorist Entry Into The United States” clearly articulates his motivation for promulgating this executive order.  However, it is important to consider the purpose of this order as it is presented in the first paragraphs:

Section 1.  Purpose.  The visa-issuance process plays a crucial role in detecting individuals with terrorist ties and stopping them from entering the United States.  Perhaps in no instance was that more apparent than the terrorist attacks of September 11, 2001, when State Department policy prevented consular officers from properly scrutinizing the visa applications of several of the 19 foreign nationals who went on to murder nearly 3,000 Americans.  And while the visa-issuance process was reviewed and amended after the September 11 attacks to better detect would-be terrorists from receiving visas, these measures did not stop attacks by foreign nationals who were admitted to the United States.

Numerous foreign-born individuals have been convicted or implicated in terrorism-related crimes since September 11, 2001, including foreign nationals who entered the United States after receiving visitor, student, or employment visas, or who entered through the United States refugee resettlement program. Deteriorating conditions in certain countries due to war, strife, disaster, and civil unrest increase the likelihood that terrorists will use any means possible to enter the United States.  The United States must be vigilant during the visa-issuance process to ensure that those approved for admission do not intend to harm Americans and that they have no ties to terrorism.

In order to protect Americans, the United States must ensure that those admitted to this country do not bear hostile attitudes toward it and its founding principles.  The United States cannot, and should not, admit those who do not support the Constitution, or those who would place violent ideologies over American law.  In addition, the United States should not admit those who engage in acts of bigotry or hatred (including “honor” killings, other forms of violence against women, or the persecution of those who practice religions different from their own) or those who would oppress Americans of any race, gender, or sexual orientation.

I strongly suggest you read this executive order in its entirety, it is very unlikely that the media will make note of this executive order, let alone provide it in their coverage of the efforts being made by the Trump administration to fulfill not only campaign promises, but more importantly, the requirements of the Constitution of the United States.

Just before our nation observed the 15th anniversary of the terror attacks of September 11, 2001 I wrote an article, “Reflection on 9/11’s Vulnerabilities: The failures that proved key factors in the attacks — and how Obama has exacerbated them.

Back then, the outcome of the impending election was not certain.  I feared that if Trump failed to win the election that our nation would face vulnerabilities under Hillary Clinton that are the stuff of my worst nightmares.

Thankfully, however, Trump did win.

He is acting swiftly and decisively to effectively address these vulnerabilities.  His executive orders, in my judgement, are consistent with the findings and recommendations of the 9/11 Commission, to which I provided testimony.  His executive orders and are entirely reasonable and, indeed, essential for the safety and security of America and Americans and provide clear and unequivocal proof of his determination to adhere to the dictates of the Constitution of the United States and hence, his oath of office.
